<br />I <br /> <br />III <br /> <br />I <br /> <br />Council Meeting Minutes <br />February 14, 1989 <br /> <br />Page 19 <br /> <br />Council Business, continued <br /> <br />Benke explained the purpose of placing for discussion the <br />development of Bury's Midwest Asphalt Property. <br /> <br />Mr. Bury has spoken to Benke in regard to the problems involved with <br />the clean-up plans for the contamination on his property. <br /> <br />Mr. Bury and the other participants in this case have excavated the <br />soil and processed it in burners. This procedure has been requested <br />by the Mi nnesota Po 11 ut ion Control Agency. Mr. Bury has been <br />advised, by his legal counsel that there may be potential <br />difficulties in selling this property. The liabilities involved <br />with this property may make financing difficult. <br /> <br />Benke asked if the site is unable to be developed, what action <br />should the City take in regard to the zoning. The City and Mr. Bury <br />should investigate the possibility of participating in the final <br />clean-up. This involvement may make redevelopment much easier. <br /> <br />The entire asphalt industry is under intense pressure by the MPCA <br />and the EPA. These organizations have proposed rules to protect the <br />public and working crews from the fumes inhaled. <br /> <br />Mattil a has spoken with Mr. Davi d Tollefson, Solve Oi 1 Company. <br />According to Mr. Tollefson, he did not have any prior knowledge of <br />the tanks being placed under the orders from the MPCA. This was <br />strictly a business deal between Midwest Asphalt and Solve Oil for <br />the placement of these tanks. <br /> <br />The tanks are very visible from the Long Lake Regional Park. The <br />Inspections Department of the MPCA had issued a permit to Midwest <br />Aspha It. The MPCA has found that the tanks were stored properl y <br />and would not be at risk to contaminate adjacent soils. <br /> <br />Benke suggested the need to investigate these environmental <br />contamination issues. <br /> <br />Williams feels this situation is very complex and finds it difficult <br />to respond because of the lack of evidence. He considers this site <br />as a valuable redevelopment location. The site should be cleaned <br />up and become more consi stent wi th the Long Lake Park area. An <br />organized approach is needed. <br /> <br />Benke feels this issue is entwined with the possibility of the <br />location of the armory/community center. <br /> <br />Council Business <br /> <br />Discussion of <br />Development of Bury's <br />Midwest Asphalt Site <br />Report 89-41 <br />
