Village of New Brighton <br />October 23, 1973 <br />Council Proceedings <br />5 <br />Motion by Rebelein, seconded by Anderson to authorize <br />Building Inspector to allow work to proceed at 7-Eleven <br />complex, 2400 County Road E under the condition that an <br />application first be filed with the administration for variances <br />for parking andside yard setback. It is a further condition <br />that no temporary certificate of occupancy be issued until <br />an abstractor's certificate has been received by the 7-11 <br />administration for the above mentioned variances. It is a Store <br />further condition that no final certificate of occupancy 2400 Cty <br />be issued until the variance request has been processed Road E <br />and ruled on by the council. It is a further condition that <br />parking on the Silver Lake Road side.of the property be <br />angular parking as suggested by the administration. <br />Motion by Fisher, seconded by Anderson to amend the above <br />motion to include that petitioner be advised that closing <br />of some driveways will be a consideration of the council at <br />the variance hearing <br />5 ayes - 0 nayes - carried <br />Vote on original motion 5 ayes - 0 nayes - carried <br />Motion by Anderson, seconded by Rebelein to receive <br />letter dated October 17, 1973, from Hiner, Inc. 3n Inc. <br />5 ayes - 0 nayes - carried-109 <br />Motion by Anderson, seconded by Eagon to accept the request <br />from Hiner, Inc. to withdraw VN -109.and not set a time <br />of hearing <br />5 ayes - 0 nayes - carried <br />Motion by Fisher, seconded by Anderson to refer R-79 to <br />rezoning petition R-79 to Planning Commission, P.C. <br />property generally located in area north of County <br />Road D. east of Old Highway 8 <br />5 ayes - 0 nayes - carried <br />Motion by Anderson, seconded by Fisher to refer rezoning R-80 to <br />petition R-80, council initiated rezoning, for the P.C. <br />property generally occupied by Sambos and A & W <br />Restaurants from I-1 to B-3 to Planning Commission <br />5 ayes - 0 nayes - carried <br />Motion by Rebelein, seconded by Anderson to approve Final Plat <br />final plat PL-89, Silver Oaks Estates #2 subject to <br />tying down of the ponding easement with the dimensions PL-89 <br />and angles as approved by the engineer. <br />5 ayes - 0 nayes - carried
