<br />,,,. <br /> <br />\ <br /> <br />SPECIAL USE PERMIT <br />SP-53 <br />January 29, 1974 <br /> <br />APPLICANT: Darrel Farr Development Corp. <br /> <br />LOCATION: Generally northwest of Minar Ford between 27th Avenue NW <br />Extended and the City gravel pit site <br /> <br />REQUEST: Special Use Permit to allow an indoor tennis facility in a <br />B-3 district <br /> <br />LEGAL REQUIREMENTS: Section ll-210(b), Uses by Special Permit, states <br />that: <br />"Amusement and recreation, armory, assembly hall, bowling alley, <br />dance hall, pool and billiards, theater, skating rink, or other <br />social, sport, or recreation center operated as a business" <br />is a permitted use by special permit in a B-3 district. <br /> <br />APPARENT OWNERS WITHIN 200 FEET: 6 <br /> <br />PLANNING DISCUSSION: <br />The property in question is currently zoned R-l and R-2. The peti- <br />tioner is requesting a rezoning to B-3 for this property, however. <br />As with the PRD any affirmative recommendation should be conditioned <br />on the rezoning. <br /> <br />The tennis facility would be situated east of an area already developed <br />for a general business use. Property ~o the west is Village owned and <br />currently zoned R-l and is not intended to be developed because of its <br />difficult site characteristics. The tennis facility would be separated <br />from residential areas to the south by a 66' right-of-way if the <br />Council ordered this improvement. To the north there are 3 story <br />apartment buildings proposed. <br /> <br />The development as proposed appears to require a variance from the <br />parking requirement. Forty-eight spaces are shown on the plan. Our <br />Zoning Code does not have a parking requirement specifically for <br />tennis facilities. The closest classification for purposes of <br />determining the parking requirement is that of "other ,:'business" where <br />one parking space is required for each 150 square feet of floor area. <br />According to this section the tennis club should have about 365 <br />parking spaces. This would definitely be more than necessary. The <br />Village of Edina has established parking requirements for this type <br />of facility of six spaces per court plus whatever is required for <br />other uses, e.g. pro shop, to which the building is put. Applying <br />this standard, the indicated parking is less than what the standard <br />would require. <br /> <br />The preliminary site plan also showed a number of deviations from <br />required setbacks. The 27th Avenue NW side of the property would be <br />the front of the property. parking areas should L,~ set ba'.::k 30' on <br />
