~;-;"J -

-~

Publiq Hearing
Special Use Permit
SP-55

May 14, 1974 -8:20 PM

R.EQUEST:

Approyal of special use permit to move\ahouse into
New Brighton

APPLICANT:

Alan Hammer

LOCATION:

526 ,Cleveland Avenue' (north of apartments)

NUMBER OF PROPERTY OWNEES WITHIN 200 FT .,~, 6

NUMBER OF PROPERTY,' OWNERS SIGNING PETITION: 3

ZONING: R-l

D'lSCUSSION:
The applicant is requesting a special use permit as required in
Section 13-090 of the Zoning Code for the purpose of moving a house
into the City.

The house isa two story frame structure about 30 years old which is
presently located in Roseville. A preliminary inspection by the
Bui'ding Inspector has shown it to be a solid house in good structural
condition.

The property is-presently occupied by a house and garage, and approval
of the request should include the condition that the existing house' be
demolished or removed within a certain period of time from when the
new house becomes habitable. This is because there can only be one
principal building on a lot in residential districts. The Council
should consider requiring a bond to guarantee demolition or removal
of (this structure. An adequate amount would be $1,000.

The State Building Co_de requires that the house conform to all require..;,
ments which must be met by a new house. Again, a bond should be
considered to guarantee conformance to this requirement. If the house
is to be moved in prior to the foundation being completed, the bond
should be large enough to guarantee construction of the foundation.
Otherwise, the permit should be conditioned on the house not being
moved in until the foundation is ready. A bond sufficient" to cover
all work in bringing it up to Code, including the foundation, would be
for $6,000.

The Building Cqdealso allows ,the City,to require a bond to cover
r~p'1-irOfany damagetc 'publicproperty~ streets and utilities. The
'Councilmignt also wish to consider this as a requirement. Here
