<br />SEABOARD SURETY COMPANY, a New York corporation, as Surety, are held
<br />and firmly boo nd unto the CITY OF NEW BRIC',HTCN, MINNESOTA, as Obligee,
<br />in the sum of ThTENTY THOUSAND AND NO/IOO ($20,000.00) DOLLARS, lawful
<br />money of the lJnited States of America to be paid unto the said CITY
<br />OF NEW BRIGHTON, MINNESOTA, its successors or assiCJns, for which pay-
<br />ment well and truly to be made, we jointly and severally bind our-
<br />selves, and each of our' heirs, executors, administrators and a,ssigns

<br />The conditions of this obligation are such that vlliEREAS, the said
<br />Principal has made application to the City of New Brighton, Minnesota,
<br />for a Special l~e Permit - SP 68 for excavating and filling certain
<br />portions of property at 251 Fifth Street Northwest, New Brighton,
<br />Minnesota, in accordance with the applicable ordinances of the City
<br />of New Brighton, Minnesota~
<br />
<br />NbW, THEREFORE, in case said Special Use Permit - SP 68 be granted,
<br />and if the said Principal shall in all materials and equ ipment by
<br />them furnished, provided or installed, and in all work done, perform-
<br />ed by them, their agents , employees, servants or representatives in
<br />the construction, installation, alterations, repairs, service or
<br />maintenance of all excavating and filling work, equipment, connections'
<br />and materials strictly comply with the provisions of the Special Use
<br />Permit of the City of New Brighton, Minnesota, and all laws of the
<br />State of Min nesota pertaining thereto, and protect, indemnify and
<br />save harmless the City of N~J Brighton, Minnesota, against all loss
<br />and damage on account of the operations of theappli cant and shall
<br />pay all fees for licenses or permits issued or required for work
<br />performed by them and all fines and penalties'for violation of any
<br />of said Ordinances, then this obligation shall be void; otherwise
<br />to be and remain in full force and effect.

<br />IN TESTIMONY \VHEREOF, the Principal and Surety have respectively
<br />caused this bond to be duly executed this 27th day of April, 1976.
