<br />I <br /> <br />I <br /> <br />I <br /> <br />Council Meeting Minutes <br />June 28, 1988 <br /> <br />Councilmember Williams asked about the policy for the issuance of <br />Peddlers' License; noting that to what extent do we want our resi- <br />dents bothered. The City Attorney informed the City Council he <br />was working with the Police Department to put together a new poli- <br />cy, providing for more latitude to deny a license, while still st- <br />aying within the constitutional rights of the applicant. Mayor <br />Benke noted that at this time, the only restriction is that of the <br />applicant being of IIsound moral character". <br /> <br />COUNCIL BUSINESS <br /> <br />Mayor Benke explained that Ms. Phyllis Reha and Mr. Ron Erickson <br />had filed a complaint with the City charging that proper procedure <br />had not been followed in determining not to underground the power <br />lines with the Long Lake Road construction. He further explained <br />the staff and City Attorney had reviewed the issue and reported <br />all legal procedures had been followed by the City. He also cove- <br />red the Council IS decision to not underground because of the ex- <br />tremely high costs involved. <br /> <br />Ronald Erickson, 1247 Long Lake Road, commented he had left the <br />Informational Hearing in November, 1987, believing the decision <br />was to underground the lines; and that the majority of residents <br />at that Hearing were of the same opinion; and that if the costs <br />escalated after that time, the residents should have been advised <br />the Council decision was being changed; and further, other estima- <br />tes should have been obtained, rather than relying on just N.S.P. <br />He also commented he felt safety was an issue in undergrounding <br />power lines. <br /> <br />Mayor Benke responded that in November, 1987, it was the intention <br />of the City Council to underground, but it was information recei- <br />ved after that meeting that caused the Council to change their <br />minds. He went on to emphasize that due to N.S.P. and their con- <br />tractors designing and installing the system, the Council did not <br />feel they had the leverage to seek outside proposals; and that se- <br />veral articles were placed in the New Brighton Bulletin, informing <br />the residents of the later decision not to underground, including <br />data leading up to this decision. <br /> <br />Councilmember Williams added that the meeting at which the final <br />decision was to be discussed, no-one testified either for or agai- <br />nst undergrounding power lines.
