<br />1707 <br /> <br />RESOLUTION NO. <br /> <br />STATE OF l>1INlTESOTA <br />C0U1:1TY OF RAMSEY <br />CITY OF NEl1 BRIGHTON <br /> <br />RESOLUTION l-1AKING FINDINGS OF FACT, DENYING SPECIAL-USE PERMIT <br />APPLICATION SP-70, AND STATn{G REASONS FOR SUCH DENIAL. <br /> <br />BE IT RESOLVED BY The New Brighton City Council that in respec <br />to Special-Use permit application SP-70, it makes the following <br />findings of fact: <br /> <br />Findinqs of Fact <br />1. On March 10, 1976 an application was received requesting a <br />special-use permit to allow operation of an amusement center at <br />535 9th St. N.W. <br /> <br />2. That such application was accompanied by the proper fee and an <br />abstract sha~ing owners of all,:properties within 200 feet of the <br />subject property. <br /> <br />13. That such application was considered by the Planning Commission <br />Ion March 16, 1976. l <br /> <br />4. That on March 23, 1976 the City Council ordered a public hearin <br />to be held on the application on April 13, 1976 at 8:15 P.M. <br /> <br />5. That mailed and published notice of such public hearing was <br />made in accordance with the law. <br /> <br />6. That a public hearing was held at the regular meeting of the <br />~ew Brighton City Council on April 13, 1976. <br /> <br />7. That at the public hearing on April 13, 1976 all persons wishin <br />to be heard were given an opportunity to state their questions and <br />positions either in favor of or opposed to such special-use permit <br />application and any reasons for such position, <br /> <br />8. That at such hearing the written report of the planner, the <br />minutes and recommendation of the Planning Commission, and the <br />testimony of the land owner were all considered. <br /> <br />9. That the applicant was not present at the hearing. <br /> <br />10. That the proposed amusement center would be located across the <br />street from an on and off-sale liquor establishment. <br /> <br />11. That inadequate on-site parking is available. <br /> <br />12, ~)at such a center may be a place of potential mischief and <br />constitute a poli~ problem. <br /> <br />13. That such a center may cause the accumulation and scattering <br />of refuse, debris, and other litter in the area. <br /> <br />14. That such a center has the potential of creating a nuisance in <br />the form of noise. <br /> <br />15. That such a center has the potential of creating an atmosphere <br />for use of alcohol and drugs on the property. <br />
