STATE OF l>1INlTESOTA C0U1:1TY OF RAMSEY CITY OF NEl1 BRIGHTON RESOLUTION l-1AKING FINDINGS OF FACT, DENYING SPECIAL-USE PERMIT APPLICATION SP-70, AND STATn{G REASONS FOR SUCH DENIAL. BE IT RESOLVED BY The New Brighton City Council that in respec to Special-Use permit application SP-70, it makes the following findings of fact: Findinqs of Fact 1. On March 10, 1976 an application was received requesting a special-use permit to allow operation of an amusement center at 535 9th St. N.W. 2. That such application was accompanied by the proper fee and an abstract sha~ing owners of all,:properties within 200 feet of the subject property. 13. That such application was considered by the Planning Commission Ion March 16, 1976. l 4. That on March 23, 1976 the City Council ordered a public hearin to be held on the application on April 13, 1976 at 8:15 P.M. 5. That mailed and published notice of such public hearing was made in accordance with the law. 6. That a public hearing was held at the regular meeting of the ~ew Brighton City Council on April 13, 1976. 7. That at the public hearing on April 13, 1976 all persons wishin to be heard were given an opportunity to state their questions and positions either in favor of or opposed to such special-use permit application and any reasons for such position, 8. That at such hearing the written report of the planner, the minutes and recommendation of the Planning Commission, and the testimony of the land owner were all considered. 9. That the applicant was not present at the hearing. 10. That the proposed amusement center would be located across the street from an on and off-sale liquor establishment. 11. That inadequate on-site parking is available. 12, ~)at such a center may be a place of potential mischief and constitute a poli~ problem. 13. That such a center may cause the accumulation and scattering of refuse, debris, and other litter in the area. 14. That such a center has the potential of creating a nuisance in the form of noise. 15. That such a center has the potential of creating an atmosphere for use of alcohol and drugs on the property.
