J \, <br />Request: <br /> <br />~pplicant: City of New Brighton Parks & Recreation Dept. <br /> <br />Location: 150 - 1st Ave. SE (Vermont Park) <br /> <br />,?-:oninq: R-l <br /> <br />Code Requirements: <br /> <br />Section 13-050 Fences states that: <br /> <br />"Fences on side street lot lines shall not be more <br />than 6 feet in height for the distance commencing <br />from a point of such side street lot line located <br />at the rear lot line and proceeding thence along <br />such side lot line to a point thereon which is 40 <br />feet distance from the front lot line, that in no <br />case shall said fence extend forward at the front <br />line of the house." <br /> <br />Thereafter, the maximum hsight permitted is 3~ feet. <br /> <br />To exceed these heights requires a special use permit <br />approved by the City Council. <br /> <br />Discussion: <br /> <br />The City of New Brighton Parks & Recreation Department is <br />requesting Council approval to construct five (5) foot <br />boundary line fences along the west property ~ine and <br />portions of the south property line of Vermont Park. <br /> <br />The Parks & Recreation Director has indicated (see memo) <br />that the fences are needed to prevent children from running <br />across Cleveland Avenue and to prevent children fram straying <br />into Mr. Perron's (property o\~nGr to the south) storage area. <br />The Parks Director has further noted that area residents have <br />requested the installation of the fences. The Parks Director <br />has indicated that a 5-foot fence is preferable aL children <br />are less apt to jump such a height as compared t:o the 3!z <br />fooJc fence. <br /> <br />The erection of fences exceeding 4~ feet in height in <br />areas not covered by the special use permit, requires either <br />the permission of the councilor the approval of adjacent <br />property owners. <br />
