Location: 150 - 1st Ave. SE (Vermont Park) ,?-:oninq: R-l Code Requirements: Section 13-050 Fences states that: "Fences on side street lot lines shall not be more than 6 feet in height for the distance commencing from a point of such side street lot line located at the rear lot line and proceeding thence along such side lot line to a point thereon which is 40 feet distance from the front lot line, that in no case shall said fence extend forward at the front line of the house." Thereafter, the maximum hsight permitted is 3~ feet. To exceed these heights requires a special use permit approved by the City Council. Discussion: The City of New Brighton Parks & Recreation Department is requesting Council approval to construct five (5) foot boundary line fences along the west property ~ine and portions of the south property line of Vermont Park. The Parks & Recreation Director has indicated (see memo) that the fences are needed to prevent children from running across Cleveland Avenue and to prevent children fram straying into Mr. Perron's (property o\~nGr to the south) storage area. The Parks Director has further noted that area residents have requested the installation of the fences. The Parks Director has indicated that a 5-foot fence is preferable aL children are less apt to jump such a height as compared t:o the 3!z fooJc fence. The erection of fences exceeding 4~ feet in height in areas not covered by the special use permit, requires either the permission of the councilor the approval of adjacent property owners.
