<br />September 78, 1976 <br />8:30 P.M. <br /> <br />~r <br /> <br />Request: SP-74, Council approval of special use permit to <br />permit erection of boundary line fence exceeding <br />3 1/2 feet in height. <br /> <br />Applicant: City of New Brighton Parks & Recreation Department <br /> <br />Location: 1550 - 29th Ave NW (Hidden oaks Park) <br /> <br />Zoninq: R-l <br /> <br />Code Requirements: <br /> <br />Section 13-050 (F-2) Fences, essentially indicates that <br />fences on side property lines shall not exceed 6 feet in <br />height for a distance along the side property line from the <br />year property line to a point which would be intersected by <br />the rear ~al'l line of the existing principal building. From <br />this point of intersection to the front lot line, boundary <br />line fences may not exceed 3~ feet in height. <br /> <br />To exceed these heights requires a special use permit <br />approved by the City Council. The applicant for the special <br />use permit is required to provide proof and reasons that the <br />special permit fence is intended. Such special fence permit, <br />if issued, may stipulate and provide for the height, location, <br />construction and type special fence thereby permitted. <br /> <br />Discussion: <br /> <br />The city of New Brighton Parks & Recreation Department <br />is requesting Council approval to construct a five (5) foot <br />boundary line fence along the north property line of Hidden <br />Oaks Park. <br /> <br />Per the above noted regulations geverning fence heights, <br />the erection of a 5-foot fence, from a point at the intersection <br />of the rear wall line of the park building under construction <br />to the front property line, requires approval of a special <br />use permit. <br /> <br />The Director of Parks & Recreation has indicated (See <br />attached letter) that the neighbors to the north have requested <br />the fence to protect their yard and bee hives from trespass. <br />Park plans indicate that the area just south of the affected <br />property owners will be developed as a hockey rink. The Parks <br />Director has indicated that a 3~ ffot fence would not be <br />adequate to discourage trespass to the property to the north. <br />
