WHEREAS, an application for a non-conforming use permit NC-32 has been made by Paul Williams and ,Northwestern Bell, to permit an expansion to a building located on property having existing Type IV non':':conformities, and WHEREAS, the procedural history of the application is as follows: 1. That an application for a non-conforming use permit NC-32 was filed with the City on July 11, 1978. 2. That the Board of Review heard and reviewed the application at its meeting on J~ly 31, 1978. i i 3. That the City Council pursuant to published and mailed notices, held a public hearing on August 8, 1978, to consider the application. All persons present at the public hearing w~re given an opportunity to be heard. I I 4. The written comments and analysis of the City Planner, the Planning Commission minutes and recommendation, and all persons 'statements made at the public hearing were considered. 'd I NOW THEREFORE BE IT RESOLVED by therCouncil of New Brighton following Findings of Fact are made NC-32. the City in respect of to ,I I That the property is currently zoned R-l and B-1. 1. 2. That the following Type IV non-conformities exist on the property: a. Lack of concrete curbing adjacent to parking areas. b. parking spaces less than the required size. c. . Insufficient amount of parking spaces. d. Lack of sufficient screening along north property line. e. Existing structure is setback less than SO ft. from R-l zoned property., 3. That in respect to the Type IV non-conformities the following improvements will be made: a. All curbing will be provided. Screening as required will be provided .along the north property line. All parking spaces will be the required size. i. I', , b. c. 4. That the property use lessens the need for additional parking.
