<br />RESOLUTION NO. <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND RECOMMENDING APPROVAL <br />OF NC-32. <br /> <br />WHEREAS, an application for a non-conforming use permit <br />NC-32 has been made by Paul Williams and Northwestern Bell, <br />to permit an expansion to a building located on property <br />having existing Type IV non~conformities, and <br /> <br />WHEREAS, the procedural history of the application is <br />as follows: <br /> <br />1. That an application for a non-conforming use permit <br />NC-32 was filed with the City on July 11, 1978. <br /> <br />2. That the Board of Review heard and reviewed the <br />application at its meeting on July 31, 1978. <br /> <br />3. That the City Council pursuant to published and <br />mailed notices, held a public hearing on August 8, <br />1978, to consider the application. All persons <br />present at the public hearing were given an <br />opportunity to be heard. <br /> <br />4. The written comments and analysis of the City <br />Planner, the Planning Commission minutes and <br />recommendation, and all persons statements made <br />at the public hearing were considered. <br /> <br />NOW THEREFORE BE IT RESOLVED by the:Council of the City <br />of New Brighton following Findings of Fact are made in respect <br />to NC-32. <br /> <br />1. That the property is currently zoned R-l and B-1. <br /> <br />2. That the following Type IV non-conformities exist <br />on the property: <br /> <br />a. Lack of concrete curbing adjacent to <br />parking areas. <br />b. parking spaces less than the required size. <br />c. Insufficient amount of parking spaces. <br />d. Lack of sufficient screening along north <br />property line. <br />e. Existing structure is setback less than <br />SO ft. from R-l zoned property. <br /> <br />3. That in respect to the Type IV non-conformities the <br />following improvements will be made: <br /> <br />a. All curbing will be provided. <br />b. Screening as required will be provided .along <br />the north property line. <br />c. All parking spaces will be the required size. <br /> <br /> <br /> <br />4. That the property use lessens the need for <br />additional parking. <br />
