'J RESOLUTION NO NEW iRIGHTON PLAN~ING COMMISSION BOARD OF REVIEW RESOLUTION MAKING FINDINGS OF FACT AND RECOMMENDING APPROVAL OF A~PtICATION FOR SPECIAL USE PERMIT, SP-88 WHEREAS, An application for a special use ~ermit ~asbeen made by RCE Corporation to allow the construction of a model unit; and WHEREAS, The procedural history of the application is as follows: 1. That an application for a .specia1 use permit, SP-88 was filed with the CityonS~ptember 4, 1919. 2. That the Board of Review heard and reviewed the application at its regular meeting on September 18,1979. 3. The written comments and analysis of the City Planner and all person's statements made at the Board of Review. meeting were considered. NOW THEREFORE BE IT RESOLVED by the Board ~f Review that the following Findings of Fact are made in resp~ct toSP-88: 1. That the property is presently zoned B-3, General Business and .is proposed to be rezoned to R-2, Two- Family Residential. 2 . T hat mod e 1 h 0 me s are perm i t t e d as. a c c e s s 0 r y use sin R-l and R-2zoning districts. 3. That this model unit will be similar to a model home and will be constructed in such a manner. 4. That the site plan for the mod~l unit makes ~se of the site plan considered for the condominium under the propos~d PRD #27. . 5. That the model unit will not have a substantially detrimental affect on adjacent properties. BElT FURTHER RESOLVED, That the application for SP-88 is hereby recommended for approval subject to the following conditions: 1. That th.e areas along Rice Cr~et Road and the proposed parking lot be landscaped as proposed in PRD #21; 2. That th~ model will be removed one year after it is installed and if it is not removed at that time the unit will become the property of the City to dispose of as it sees fit.
