The City Council has not <br />as yet considered the final plan or plat. The applicant is <br />proposing to construct a model unit on the site proposed for the <br />condominium buildin~. The applicant's reason for requesting the <br />construction of the model is to secure sales for the condo~inium <br />prior to construction. <br /> <br />Under Section 7-030 a. of the Zoning Code which makes reference to <br />Section 7-020 i.model homes are permitted acc~ssory uses in an <br />R~2district. However, it seems that this proposal is not what <br />is usually consid~~ed a.model home for the following reasons: <br /> <br />1. The unit will not be sold and inhabited in this <br />particular location; <br />2 . It wi 11 be sit u ate d on a temporary foundation ; and <br />3. It will not be serviced by wat~r and ~ewer services. <br /> <br />In light of thes~ deviations it i~ the opinion of the City Attorney <br />that the applicant must obtain a special use permit for the <br />construction of this unit. <br /> <br />In examination of the applicant's site plan, it should be noted <br />that the model unit will make use of the proposed driveway and <br />parking area for the proposed condominium under PRD #27. In <br />addition, the applicant is proposing to install pl~ntings to the <br />north of the model to screen the model from the construction site <br />for the condominium. The proposed landscaping seems inadequate <br />because the applicant is not proposing any landscaping along Rice <br />Creek Road. The landscaping proposed for thi~ area ~n the plan <br />for the condominium site should be installed to screen the <br />parking area from Rice Cre~k Road and to enhance the appeat~nce <br />of the model. <br />
