<br />Septem~er 13, 1979 <br /> <br />..' <br /> <br />0' <br /> <br />APPLICATION FOR SPECIAL USE PERMIT <br />SP-88, RCf CORPORATION <br /> <br />PURPOSE <br /> <br />To exa~ine a request for a ~pecial use permit to construct a model <br />unit. <br /> <br />BACKGROUND <br />APPLICANT: <br /> <br />RCE Corporation <br />Richard Ernst <br /> <br />LOCATION: <br /> <br />Generally nGrth of RiCe Creek Road and <br />w~st of th~RiceCreek Shopping C~nter <br /> <br />EXISTING ZONING: <br />PRO PO SED .Z 0 N 1 N G : <br /> <br />B-3., General Business <br /> <br />R-2, Two F~mily Residential <br /> <br />AREA OF PROPOSED BUILDING: 361 x 32', 1152 squar~ feet <br /> <br />The Planning Commission has approved the final plan and final plat <br />for PRD #21 with a number of conditions. The City Council has not <br />as yetcons~dered the final plan or plat. The appli~ant is <br />proposing, to construct a model unit on the site~roposed for the <br />condominium building. The applicant's reason for requesting the, <br />construction of the model is to secure sales for .the condominium <br />prior to construction. <br /> <br />Under Section 7-030 a. of the Zoning Code which makes reference to <br />Section 7-020 i. model homes are permitted accessory uses in an <br />R-2 district. However, it seems that this proposal is not what <br />is usually considered a model home for the following reasons: <br /> <br />1. The unit will not be sold and inhabited in this <br />particular location; , <br />2. It will be situated on a temporary foundation; and <br />3. It will not be serviced by water and s~wer services. <br /> <br />In light of these deviations it is the opinion of the City Attorney <br />that the applicant must obtain a special use permit for the <br />construction. of this unit. <br /> <br />In examination of the applicant's site plan, it should be noted <br />that the model unit will make use of the proposed driveway and' <br />pa~king area for the proposed condominium under PRD#27. In <br />addition,the applicant is proposing to install plantings to the <br />north of the model to screen the model from the construction site <br />for the condominium. The proposed landscaping seems inadequate <br />because the applicant is not proposing any landscaping along RicQ <br />Creek Road. The lan~scaping proposed for this area on the. plan <br />for the condominium site should be installed to Screen the <br />parking area from Rice Creek Road and to enhanc~ the appearance <br />of the model. <br />
