The City Council has not <br />as yet considered the final plan or plat. Th~,applicant is <br />proposing to construct a model unit on the site propos~d for the <br />condominium building. The applicant's reason for requesting the" <br />construction of the model is to secure sales for the condominium <br />prior to construction. <br /> <br />Und~r Section 7-030 a. of the Zoning Code which makes r~ference to <br />Section 7-020i. model homes are permitted accessory uses in an <br />R~2 district. However, it seems that this proposal is not what <br />is usually considered a model home for the following reasons: <br /> <br />1. The unit will n6t be sold and inhabited in this <br />particular location; <br />2. It will besituat~don a temporary foundation; and <br />3. It will not be serviced by water and sewer services. <br /> <br />In light of these deviations it is the opinion of the City Attorney <br />that the applicant must obtain a special use permit forth~ <br />construction of this unit. <br /> <br />In examination of the applicant's site plan, it should be noted <br />that the model uni t wi 11' make use of, the proposed "dri veway and <br />parking area for the proposed condominium under PRD #27. In <br />addition, the applicant is proposing to installplantings to the <br />north of the model tN'screen the model from the construction site <br />f~rthe.coridominium. The proposed landscaping seems inadequate <br />because the applicant s not propOSing any landscaping along Rice <br />Creek Road. The landscaping proposed, for this area on the plan <br />for the condominium site shQuld be installed to screen the <br />parking area from Rice Creek Road and to en~ancethe appearance <br />of the model. <br />
