<br />I <br /> <br />I <br /> <br />I <br /> <br />Council Meeting Minutes <br />April 26, 1988 <br /> <br />Exterior storage can only be in a rear yard: LeFevere was not <br />sure where storage would be (may have front yard storage where <br />there is none currently). <br /> <br />The buildings and grounds are to be in an appearance that is <br />in harmony with surrounding land uses: you will have new sur- <br />rounding uses. <br /> <br />Industrial uses shall not be so altered or modified to con- <br />flict with a number of listed performance standards (sound and <br />noise levels, for example, which are measured at the lot <br />line): This would be an alteration that could conflict with a <br />number of performance standards (new lot lines would be closer <br />than the distance of the current lot lines on the south side). <br /> <br />Some vibrations are perceptible beyond the <br />site on which the use is located: Again, <br />lot lines and whether or not there will be <br />from the operation would be a question. <br /> <br />lot line of the <br />there will be new <br />vibrations coming <br /> <br />A question of discharge of any toxic or noxious matter outside <br />of the property line, emission of odorous matter of such a <br />quality as to be readily detectable beyond the lot line of the <br />site: The lot line is closer, but LeFevere did not know if <br />there are ~ny odors associated with the sites. <br /> <br />Fences be provided for outside storage and exterior treatment <br />on the street side of the structure shall be bt'ick, stone, <br />etc.: Now we have a new street proposed. <br /> <br />In theory, LeFevere stated those items ought to be addressed. <br /> <br />Benke stated the concerns and impacts identified by LeFevere could <br />happen; believes everyone's perception has been to redevelop and <br />relocate the asphalt plant so the question becomes how do you <br />guarantee that the asphalt plant leaves. <br /> <br />LeFevere stated if none of his concerns are legitimate the council <br />has nothing to say about whether or not the asphalt plant moves; <br />however, if the asphalt plant stays and creates an unacceptable <br />level of non-conforming uses, then the council, if they approve <br />this plat, presumably would want to make sure there is some guar- <br />antee or assurance that the plant would be discontinued so the <br />problem would not reoccur upon final plat approval. <br /> <br />Benke stated council and history is on record on this particular <br />parcel (both from a Comprehensive Plan and a Zoning perspective) <br />as sensitive industrial; insisted that the development on that <br />site, or a portion of that site, be in conformance with the sensi- <br />tive industrial zoning; and obviously the asphalt plant being <br />there is not in conformance so it would be hard to argue that it <br />is not a concern. <br /> <br />Page 7 <br />
