Christenson <br />LOCATION: 2892 Rice Creek Terrace <br />AREA OF COURT: 6325 Squar~ feet <br />HEIGHT OF FENCE; 10' <br /> <br />SETBACKS: In one area on the west side, the court and fence <br />will be setback only 3 feet from the property <br />1 i n e . . ..' '. <br /> <br />APPLICABLE CODE REGULATIONS <br /> <br />A. Section 11-090 Uses by special permit, g., states <br />"g. Tennis court~. provided that they are accessory <br />to a permitted principal use and are located in a <br />yard other than a rear yard." .' <br /> <br />B. Section 13-050 c. 6. states generally that special <br />purpose fences can pe allowed by special use permit <br />if such, fences meet the following criteria: . <br /> <br />1) Such special permit purpose fences are neceS.sary to <br />protect and buffer the premises for which suc~ . <br />fence$ are intended or adjacent premises. and <br />2) Would not be deleterious to adjacent propertl. <br />nor to the general public health, safety or . <br />welfare, and <br />3) Would not be inconsistent with the intent and <br />purpose of these fence regulations as $tated in <br />Section 13-050 a. . <br /> <br />Such special fence permit, if issued. may <br />stipulate and provide for the height. location <br />and construction type of special fence thereby <br />permitted or any other condition deemed necessary <br />to protect the public hea1tb, safety and general <br />welfare. <br />
