<br />RESOLUTION NO. <br /> <br />II <br /> <br />NEW BRIGHTON PLANNING COMMISSION <br />BOARD OF REVIEW <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND RECOMMENDING APPROVAL OF <br />SPECIAL USE PERMIT, SP-93, AND PRELIMINARY PLAT, PL-122 <br /> <br />,I <br />II <br /> <br />II <br />II <br />'I <br />I, <br />II <br />II <br />I <br />I <br />I <br />II <br />I <br /> <br />WHEREAS, An application for a special use permit, SP-93 <br />and preliminary plat, PL-122 has been made by HFA Investments, <br />Inc. to allow the platting and construction of a four unit <br />townhouse ~n a site zoned R-2, Two Family Residential, and <br /> <br />WHEREAS, The procedural history of the application is as <br />follows: <br /> <br />1. That an application for a special use permit SP-93 and <br />and preliminary plat, PL-122 with the City on June 5, <br />1980. <br />2. That the Board of Review heard and reviewed the <br />application at its regular meeting on June 17, 1980. <br />3. The written comments and analysis of the City Planner <br />and all personls statements made at the Board of <br />Review meeting were considered. <br /> <br />NOW THEREFORE BE IT RESOLVED by the Board of Review that <br />the following Findings of Fact are made in respect to SP-93, <br />PL-122: <br /> <br />II <br />I <br /> <br />1. That the property is zoned R-2. Two Family Residential; <br />2. That the site is approximately one acre in size and <br />the four units are within the allowed density in an <br />R-2 District; <br />3. That the site plan provides for a design and layout of <br />the units that are compatible with surrounding <br />development; <br />4. That the Comprehensive Plan states that this area <br />provide for a buffer between the single family <br />dwellings and apartment complex and this development <br />provides such a buffer without adversely affecting <br />adjacent single family development; <br />5. That all parking and driving areas are located on the <br />eastern portion of the property and are therfore <br />removed from the single family development; <br />6. That the subdivision of the property meets all zoning <br />code requirements in regard to lot dimension and <br />setbacks; and <br />7. That the subdivision of the property provides for <br />separate legal descriptions for each unit allowing <br />for owner-occupied units. <br /> <br />II <br /> <br />BE IT FURTHER RESOLVED. That the Board of Review hereby <br />recommends approval of SP-93 adn PL-122 contingent on the <br />following conditions: <br /> <br />I <br />I <br />II <br />II <br />Ii <br />,I <br />:1 <br />II <br />I, <br />I. <br />Ii <br />II <br />II <br /> <br />1. Approval of LP-10l; <br />2. That the large western area be well-maintained and <br />landscaped to provide screening of the building and <br />parking area; <br />3. That no recreational facilities for the residents <br />of the proposed development be closer than 30 feet <br />from the northern or western property lines; <br />4. That any accessory storage buildings if any shall be <br />behind the building adjacent to the parking area and <br />not be of metal material and also be screened through <br />landscaping; <br />5. The landscape plan should be revised to include <br />plantings in the front and side yards to break up <br />the bulk of the building and screen the driveway and <br />parking area from the adjacent R-2 dwelling to the <br />east; and <br />
