<br />e <br /> <br />RESOLUTION NO <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING APPLICATION <br />FOR SPECIAL USE PERMIT, SP-94 <br /> <br />WHEREAS, An application for a special use permit entitled <br />SP-94 has been made by Mister Donut, establish a sign plan <br />for a shopping center located generally on the northeast <br />corner of County Road "E" and Silver Lake Road, and <br /> <br />WHEREAS, The procedural history of the application is <br />as follows: <br /> <br />. <br /> <br />1. That an application for special use permit, SP-94 <br />was filed with the City of New Brighton on <br />November 13, 1980. ' <br />2. That such application was reviewed by the New <br />Brighton Planning Commission Board of Review <br />on November 18, 1980 and December 16, 1980. <br />3. That the City Council, pursuant to published and <br />mailed notices, held a public hearing on January 13 and <br />februa,ry': ] 0;; ] 981 ,. a n'pers.on:'si, present a t--: ,the,hea ri ng <br />we re': g:i ven ~n' OPPQr:t!Jn i ty ,to,. be. i1 ea,rd',< , <br />4. the written comments ~nd analysi~ of th~ City <br />staff, the Plannin~ Commission minutes and <br />recommendations were considered. <br /> <br />NOW THEREFORE BE IT RESOLVED, That the New Brighton City <br />Council makes the following Findings of Fact in respect <br />to SP-94: <br /> <br />1. That the property is zoned B-3, General Business; <br />2. That the sign ordinance of the New Brighton <br />Zoning Code allows one ground sign for a <br />shopping center; <br />3. That the shopping center has never been <br />identified by name; <br />4. That the proposed ground sign and existing wall <br />signs meet the regulations outlined in the zoning <br />code under the "Table of Basic Design Elementsll. <br /> <br />e <br /> <br />BE IT FURTHER RESOLVED, That the application SP-94 is <br />and hereby approved subject to the following conditions: <br /> <br />1. That the ground sign be at least 10 feet from <br />any property line, be no more than 19 feet <br />in height, and 60 square feet in area; <br />2. That each tenant be allowed one wall sign <br />identifying tenant name only and that each <br />sign be restricted in size and location by <br />the Table of Basic Design Elements of <br />the Zoning Code and be based on the tenants <br />lineal feet of frontage; <br />3. That there be no permanent window signs <br />allowed on the building; <br />4. That any existing wall signs that are non- <br />conforming to this sign plan will be removed <br />within 5 years and made to conform. <br />
