,.

December 10, 1980

APPLICATION FOR SPECIAL USE PERMIT
SP-94 MISTER DONUT

PURPOSE

To consider a request for a special use permit for a sign plan for a
shopping center.

BACKGROUND

APPLICANT:
LOCATION:

ZONING:
PREVIOUS COUNCIL ACTION:

Mister Donut

2400 County Road liE II
Shopping center located on the
northeast corner of Silver Lake Road
and County Road liEu.

B-3, General Business

The City Council at its October 23,
1973 meeting approved a 39~ square
foot ground sign for the 7-11 store.
This approval was prior to the City's
existing sign ordinance.

APPLICANT'S REQUEST

The applicant has constructed a free-standing ground sign 19 feet in
height and 60 square feet in area without a permit to do so.

According to Section 14-180 b.2. of the Zoning Code "shopping centers
should be'indentified by a single ground sign for the purpose of
center identification. It should display no more than five (5) items
and identify the center, not advertise individual businesses therein."

The proposed sign (see attachment) reads "Mister Donut", which is an
advertisement for one business and not identification for the shopping
center. The propoerty owner of the center has agreed to the "Mister
Donut" Company applying for the ground sign. (See attached letter).

The areas of special control such as shopping centers allow the City
to negotiate sign plans with the property owners. The request does
not specifically meet the regulatons in the sign code. There might
however be rationale for supporting this request, such as:

1. That this shopping center has never had identification for
the name of the center, the 7-11 store has been identified
on the ground sign;
2. Staff is unsure that the shopping center has a name that
would identify the center;
3. That the tenants of the center and property owner support
the request that Mister Donut be identified on the ground
sign; and
4. That past sign plans approved by the City Council for
buildings with multiple occupancy of small size be allowed
plates listing individual tenants. In this case the sign
plan would have a ground sign identifying only one tenant.
