<br />~ <br /> <br />1m RESOLUTION NO <br /> <br />NEW BRIGHTON PLANNING COMMISSION <br />BOARD OF REVIEW <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND RECOMMENDING APPROVAL <br />OF SPECIAL USE PERMIT, SP-94 <br /> <br />WHEREAS, An application for a special use permit, SP-94 has <br />been made by Mister Donut with the permission of the property <br />owner to establish a sign plan for a shopping center; and <br /> <br />WHEREAS, The procedural history of the application is as <br />follows: <br /> <br />1. That an application for a special use permit SP-94 was <br />filed with the City on November 13, 1980. <br />2. That the Board of Review heard and reviewed the <br />application at its regular meeting on November 18, 1980. <br />3. The written comments and analysis of the City Planner <br />and all person's statements made at the Board of Review <br />meeting were considered. <br /> <br />NOW THEREFORE BE IT RESOLVED By the Board of Review that <br />the following Findings of Fact are made in respect to SP-94; <br /> <br />1. That the property is zoned 8-3, General Business; <br />2. That the sign ordinance of the New Brighton Zoning <br />Code allows one ground sign for a shopping center; <br />3. That the Shopping center has never been identified <br />by name; <br />4. That the proposed ground sign and existing wall signs <br />meet the regulations o~tlined in the zoni~g code under <br />the "Table of Basic Design Elements". <br /> <br />BE' IT FURTHER RESOLVED, Tha t the Board of Revi ew recommends <br />approval of SP-94 subject to the following conditions: <br /> <br />6 <br /> <br />1. That the ground sign be at least 10 feet from any <br />property line, be no more than 19 feet in height, <br />and 60 square feet in area; <br />2. That each tenant be allowed one wall sign identifying <br />tenant name only and that each sign be restricted <br />in size and location by the Table of Basic Design <br />Elements of the Zoning Code and be based on the <br />tenants lineal feet of frontage;,J~- ;)' <br />That there be no Bt~e~ permanentV~signs allowed on <br />the building ~ll:d:l.!} permanent windov" signs; <br />4. That any existing wall signs that are non-conforming to <br />this sign plan will be removed within 5 years and <br />made to conform. <br />5. That the southern driveway on Silver Lake Road be closed <br />within nine months of approval; and <br />6.
