<br />/ <br /> <br />~ <br /> <br />II <br />II <br />I <br />I <br />i <br />I <br />I <br /> <br />RESOLUTION NO. 2423 <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING APPLICATION FOR <br />SPECIAL USE PERMIT, SP-94 <br /> <br />WHEREAS, An application for a special use permit entitled <br />SP-94 has been made by Mister Donut, to establish a sign plan <br />I for a shopping center located generally on the northeast corner <br />of County Road "E" and Silver Lake Road, and <br /> <br />I <br /> <br />!, <br />II <br />I <br />I <br />I <br />i <br />I <br /> <br />WHEREAS, The procedural history of the application is as <br />follows: <br /> <br />1. <br /> <br />That an application for special use permit, SP-94 <br />was filed with the City of New Brighton on November <br />13, 1980. . <br />That such application'was reviewed by the New Brighton <br />Planning Commission Board of Review on November 18, <br />1980 and December 16, 1980. <br />That the City Council, pursuant to published and:.. <br />mailed notices, held a public hearing on January 13, 198 <br />and February 10, 1981, all person's present at the heari g <br />were given an opportunity to be heard. <br />The written comments and analysis of the City staff, <br />the Planning Commission minutes and recommendations were <br />considered. <br />That the property owner and existing tenants have <br />indicated support and approval of the sign plan. <br /> <br />2. <br /> <br />3. <br /> <br />, 4. <br /> <br />5. <br /> <br />I NOW THEREFORE BE IT RESOLVED, That the New Brighton City <br />I Council makes the following Findings of Fact in respect to <br />I SP-94: <br /> <br />I <br />I <br />I <br /> <br />\, <br />II <br />II <br />I <br />1 <br /> <br />1. <br />2. <br /> <br />That the property is zoned B-3, General Business; <br />That the sign ordinance of the New Brighton zoning <br />Code allows one ground sign for a shopping center; <br />That the shopping center has bever been identified <br />by name; <br />That the proposed ground sign and existing wall <br />signs meet the regulations outlined in the zoning <br />Code under the "Table of Basic Design Elements". <br /> <br />3. <br /> <br />4. <br /> <br />BE IT FURTHER. That the ground sign be at least 10 feet from any <br />property line, be no more than 19 feet in height, <br />and 60 square feet in area; <br />2. That each tenant be allowed one wall sign identifying <br />tenant name only and that each sign be restricted in <br />size and location by the Table of Basic Design Elements <br />of the Zoning Code and be based on the tenants lineal <br />feet of frontage; <br />3. That there be no permanent window sign allowed on the <br />building; <br />4. That any existing wall signs that are non-conforming <br />to this sign plan will be removed within five (5) <br />years and made to conform. <br />
