RESOLUTION NO STATE OF MINNESOTA COUNTY OF RAMSEY CITY OF NEW BRIGHTON RESOLUTION MAKING FINDINGS OF FACT AND APPROVING APPLICATION FOR SPECIAL USE PERMIT, SP-96 WHEREAS, An application for a special use permit entitled ,SP-96 has been made by PDQ Food Stores to permit the sale of gasoline and construction of one gasoline service station. L~HEREAS, The procedural history of the application is as follows: 1. That an application for special use permit, SP-96 was filed with the City of New Brighton on February 25, 1981. 2. That such application was reviewed by the New Brighton Planning Commission Board of Review on March 17, 1981. 3. That.the City Council, pursuant to published and mailed notices, held a public hearing on April 14. 1981, all person's present at the hearing were given an opportunity to.be heard. 4. The,written comments and analysis of the City staff, the Planning Commission minutes and recommendations were considered. NOW THEREF.ORE BE IT RESOLVED, That the New Brighton City Council makes the following Findings of Fact in respect to SP-96: 1. That the prope~ty is zoned B-2, Neighborhood Business; 2. That there are commercial uses to the east and an apartment complex to the north and west; 3. That the site is located on major thoroughfare, County Road "D"; and 4. That the proposed use will not adversely affect the surrounding land uses. BE IT FURTHER RESOLVED, That the application for special use permit, SP-96, is and hereby approved contingent on the following conditions: 1. That the location of the service island and pumps conforms to the site plan dated and signed by the applicant and City Planner; 2. That the open area west of the service island be sodded and contain plantings to screen the pumps and be well-maintained; and 3.
