<br />RESOLUTIONNo.~ 2436 <br /> <br />( .'? <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING APPLICATION FOR <br />PHELIMINARY PLA..~NED RESIDENTIAL DEVELOPMENT, PRD-3l ' . . <br /> <br />WHEREAS an application for a preliminary <br />Development entitled PRD-31 has been made by <br />on a site located generally on the southeast <br />Lake Road and County Road "E", <br /> <br />.. <br /> <br />Planned Residential <br />Belair Builder~S <br />corner of Silver <br /> <br /> <br />':-:-< <br /> <br />WHEREAS the procedural history of the application is as <br />follows: <br /> <br /> <br />1. That an application for a Preliminary Planned Residential <br />Development was filed with the City of New Brighton on <br />February 26, 1981; <br />2. That such application was reviewed by the New Brighton <br />Planning Commission Board of Review on March S, 1981; <br />3. That the city Council, pursuant to published and <br />mailed notices, held a public hearing on March 24, 1981, <br />all person's present at the hearing were given an <br />opportunity to be heard, <br />4. The written comments and analysis of the City staff, the <br />Planning ,Commission minutes and recommendations \vere' <br />considered. <br /> <br />NOW THEREFORE BE IT RESOLVED, that the New Brighton City <br />Council makes the following Findings of Fact in respect to <br />PRD-3l: <br /> <br />1. That the proposed residential development is consistent <br />with the Comprehensive Plan; <br />2. That the proposed development with conditions would not <br />be detrimental to public health, safety, morals and <br />general welfare of the surrounding area; <br />3. That the proposal is consistent with the stated purposes <br />of the PRD ordinance as it makes the most efficient <br />use of the land and open space; <br />4. That the proposal involves the development of a site with <br />unique development constraints and characteristics. <br /> <br />BE IT FURTHER RESOLVED, that the application for preliminary <br />PRD-31 is and hereby approved contingent on the following <br />conditions: ' <br /> <br />I. That all grading, drainage, street and utilities be <br />subject to approval of the City Engineer, Rice Creek <br />Watershed District and DNR, <br />2. That all fire hydrant locations, fire and emergency <br />lanes, sprinkling connections, emergency access ladders, <br />etc., shall be subject to the approval of the Fire <br />Department; _ <br />3. The condominium building shall be built for indi~idual <br />uni t ovmership, have,ua: brick exterior, havipg: undeqr~':L:_ <br />ground parking; <br />4. That the final plans for the three (3) story condominium <br />buildings shall show the final plat for division of the <br />building into separate units; <br />5. That the access to the site from the west be off of Windso <br />Lane not Silver Lake Road and be subject to approval by <br />
