<br />SP-98 <br />Page #2 <br /> <br />PLANNING COMMISSION CONSIDERATION & RECOMMENDATION <br /> <br />EXTRACT FROM MINUTES <br />BOARD OF REVIEW <br />REGULAR MEETING <br />MAY 19, 1981 <br /> <br />Staff briefly reviewed the application for a special use permit to <br />allow excavation of a site located west of Silver Lake Road and <br />north of County Road "E" which is zoned R-l, Single Family Residential. <br /> <br />John Steng1ine and Mike Murlowski, the applicants, were present to <br />answer questions. <br /> <br />Commissioner Knuth voiced a concern over the safety of area residents <br />during the excavation period and felt that the applicant should <br />submit generalized restoration plans. He further commented that a <br />written agreement assuring the safety of the slopes and the <br />stability should be provided by the applicant. <br /> <br />Commissioner Livingston stated that in the past mining operations <br />have been considered for this site on a larger scale and that there <br />has been neighborhood opposition to that process. He felt that the <br />operation should be watched closely so that the excavation is <br />proper1yhand1~d. He stated that he had some reservations based on <br />the past experiences and that staff should monitor the hours of <br />operation and the dust control during excavation. <br /> <br />Staff commented that item #3 of the proposed resolution under BE <br />IT FURTHER RESOLVED should be amended to include the number of cubic <br />yards to be excavated and to indicate the hours of operation. <br /> <br />Commissioner Knuth indicated that the City Engineer should be <br />further consulted pertaining to the amount requested for the per- <br />formance bond. <br /> <br />Motion by Livingston, second by Sande to recommend approval of SP-98 <br />by adopting a resolution with the following conditions: <br /> <br />1. That site restoration plans including details on the <br />grading of the site during excavation and consideration <br />of the stability of resulting slopes are approved by <br />the City Engineer; <br />2. That the applicant post a performance bond in the amount <br />of $20,000 to insure the City of proper site restoration; <br />3. That the excavation/special use permit expires sixty (60) <br />days after the date of approval, that no more than 10,000 <br />cubic yards of material is removed and that the excavation <br />take place between the hours of 7:30 a.m. to 3:30 p.m.; and <br />4. That the applicant conform with excavation, fill and grading <br />plans approved by the City Engineer. <br />4 Ayes - 0 Nayes, Motion Carried <br />
