<br />RESOLUTION ND <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RA~1S EY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKlNG FINDINGS OF FACT AND APPROVING APPLICAtION FOR <br />SPECIAL USE PERMIT, SP-98. <br /> <br />t: <br />f. <br /> <br />~ <br /> <br />;; <br /> <br />.. <br />~ <br /> <br />, <br />~t <br /> <br />~ <br /> <br />WHEREAS, An application for a speical use permit entitled <br />SP-98 has been made by Belair Builders zonea R-l, Single Family <br />Residenti al. <br /> <br />WHEREAS, The procedural history of the application is as <br />follows: <br /> <br />1. That an application for a special use permit, SP-98 was <br />filed with the City of New Brighton on May 13, 1981. <br />2. That .such application was reviewed by the New Brighton <br />Planning Commission Board of Review on May 19, 1981. <br />3. That the City Council, pursuant to published and mailed <br />notices, held a public hearing on June 9, 1981, all <br />person's present at the hearing were given an opportunity <br />to be heard. <br /> <br />NOW THEREFORE BE IT RESOLVED, That the New Brighton City <br />Council makes the following Findings of Fact in respect to SP~98: <br /> <br />1. That the property is zoned R-l, Single Family Residential; <br />2. That the property has been mined in the past and has a <br />large deposit of fill material; <br />3. That the excavation site is close in proximity to the <br />development site and therefore reduces the hauling . <br />distance; and <br />4. That the proposed route is designed to be removed from <br />residential areas and utilizes major thoroughfares of <br />County Road "E" and Silver Lake Road and should not have <br />adverse affect on those area residents and roadways. <br /> <br />BE IT FURTHER RESOLVED That the application SP-98 is and <br />hereby approved subject to: <br /> <br />1. That site restoration plans including details on the grad- <br />ing of the site during excavation and consideration over <br />stability of resultirig slopes are approved by the City <br />Engineer; <br />2. That the applicant post a performance bond in the amount <br />of $20,000 to assure the City of proper site restoration; <br />3. That the excavation/special use permit expires 60 days <br />after the date of approval, that no more than 10,000 cubic <br />yards of material is removed and that the excavation take <br />place between the hours of 7:30 a.m. to 3:30 p.m.; and <br />4. That the applicant conform with excavation, fill and grad- <br />ing plans approved by the City Engineer. <br /> <br />ADOPTED THIS <br /> <br />day of <br /> <br />, 1981. <br /> <br />Roger V.
