-III'~.-/- '_ "',~J e e - e RESOLUTION NO STATE OF MINNESOTA COUNTY OF RAMSEY CITY OF NEW BRIGHTON RESOLUTION MAKING FINDINGS OF FACT AND DENYING APPLICATION FOR SPECIAL USE PERMIT, SP-99 ..' WHEREAS, an application for a special use permit entitled SP-99 has been madebYdThomas"BoudrE.au_ to construct an amateur radio tower/antenna at 6~0 23rd Avenue NW; and WHEREAS, the procedural history of the application is as follows: 1. That an application for a special use permit was filed with the City of New Brighton on September 3, 1981. 2. That the Planning Commission, pursuant to published and mailed notices, held a public hearing on October 1,1981 and October 20, 1981, all personls present at the hearing were given an opportunity to be heard. 3. That such application was considered by the City Council on December 8, 1981, 4. The written comments and analysis of the city staff, the Planning Commission minutes and recommendations were. considered. NOW THEREFORE BE IT RESOLVED, that the New Brighton City Council makes the following Findings of Fact in respect to SP-99: 1. That the proposed site is zoned R-l, Single Family Residential; 2. That the overall height of the tower/antennae is 80+ feet; 3. That the lot dimenslon in question is 65.7 feet wide and 275.45 feet deep; 4. That the application does not meet the setback requirements for the structure (Section 4-600 b.l and c.2.) the guy anchors (Section 4-600 b.2) and antenna devices (Section 4-600 b.2); and 5. That the tower does not meet the required setback from an overhead electrical power line which serves more than one dwelling (Section 4-600 6.5.)
