<br />May 13, 1982 <br /> <br />.. <br /> <br />APPLICATION FOR SPECIAL USE PERMIT <br />SP-l 01, SALEt~ BAPTIST CHURCH <br /> <br />PURPOSE <br /> <br />To reconsider application for special use permit to use a single <br />family dwelling for classrooms. <br /> <br />BACKGROUND <br /> <br />APPLICANT: <br />LOCATION: <br />ZONING: <br />PREVIOUS ACTION: <br /> <br />Salem Baptist Church <br /> <br />1995 Silver Lake Road <br /> <br />R-1, Single Family Residential <br /> <br />See Attached Planning Commission <br />Minutes and Council Minutes <br /> <br />STAFF COMt.1ENTS <br /> <br />This application has been submitted tD the Planning CDmmission to <br />review in regard to compliance with condition #6 of the previDusly <br />approved Planning Commission resolution in light of the now prepared <br />plan for remDdeling the structure to meet Building Code requirements <br />and secondly to recDmmend a resolution making Findings of Fact to <br />the Council. <br /> <br />BUILDING CODE COMPLIANCE <br /> <br />The applicant's have agreed to bring this structure up to cDdetD <br />comply with the Building Code requirements to make this a public b.uild- <br />ing. This house will be substantially remodeled into large classrooms <br />with a fire corridor and handicap restrooms. The interiDr .of the <br />structure will therefore be similar to an office building - walls will <br />be changed, kitchen remDved, clDsets eliminated and 1st floDr will <br />basically be two large rooms. The house will have exterior decks that <br />will be used to provide handicap access tD the structure (see attached <br />plan). <br /> <br />SPECIAL USE PERMIT <br /> <br />As a result of the substantial alteration to the structure, it cDuld <br />not easily and it is doubtful that it wDuld not be economical to <br />convert the structure back to a residential use. Therefore, it is a <br />major land use decision whether this home should be somewhat per- <br />manently a public building. The Council IS concern over approving this <br />structure for public use ~ twofold: <br /> <br />,. That the CDuncil would not be able to affectively or <br />possibly legally deny other public uses of the structure; and <br />2. That the approval of this use for this specific site does <br />put the City in the position to approve similar uses of <br />other single family homes throughout the City. <br /> <br />Staff has been directed to prepare a resDlution to provide findings <br />that would isolate this application if it were tD be apprDved. FDr <br />Planning Commission review and comment staff has prepared the attached <br />Findings of Fact and cDnditions. <br />
