<br />.. <br /> <br />~ <br /> <br />RESOLUTION NO <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING APPLICATION <br />FOR SPECIAL USE PERMIT, SP-10l <br /> <br />WHEREAS, an application for a special use permit entitled <br />SP-IOl has been made by Salem Baptist Church to permit the use <br />of a single family dwelling for classrooms; and <br /> <br />WHEREAS, the prDcedural histDry .of the application is as <br />follows: <br /> <br />1. That an application for Special Use Permit, SP-101 <br />was filed with the City .of New BrightDn on NDvember 3,l~8)! <br />2. That the Planning Commission, pursuant to published and <br />mailed notices, held a public hearing on NDvember 17, <br />1981, all persDns present at the hearing were given an <br />opportunity tD be heard. <br />3. That such applicatiDn was reviewed by the City Council on <br />NDvember 24, 1981, December 8, 1981, December 22, 1981, <br />January 26, 1982, March 9, 1982, May 11, 1982 and <br />May 25, 1982. < <br />4. The written comments and analysis of the city staff, the <br />Planning CDmmission minutes and recommendations were <br />considered. <br /> <br />NOW THEREFORE BE IT RESOLVED, that the New Brighton City <br />Council makes the fDllowing Findings of Fact in respect to <br />SP-10l: . <br /> <br />1. That the property is zoned R-l, Single Family Residential; <br />2. That the site is contiguous to the Church property; <br />3. That the Church and its ~-_~ oro_ _.--~~~~~,~~ is the sole <br />user of the property; ~ <br />4. That the Church will .only use the property fDr classroDm~ <br />fDr 1 hour ~Sundays and l~ hDurs on Wednesday evenings <br />that at all~imes the structure would be vacant; <br />5. That the proposed classroom use would nDt create noise <br />~~pr~~s for the neighborhood and parking wDu1d be <br />~pr~d for on the adjacent Church parking 10t~there <br />will be no vehicular parking .on the classroDm slte; <br />6. That the structure has maintained its residential exterior <br />character and will from an exterior appearance be <br />compatible with surrounding residential structures; <br />7. That the grounds will be maintained and have a residential <br />appearance with no public/commercial type accessory <br />structures; <br />8. That the structure will not be physically expanded in <br />any way and therefore maintain limited use in regard <br />to numbers of users; <br />9. That there are nD signs nor will there be any signs <br />identifying that the property is being used for church <br />classrooms; <br />10. That the Church property and property in question will be <br />legally combined into one parcel before occupancy of <br />said classroom structure and that said parcel can not be <br />separated \>Jithout Council apprDval. of a subdivision. <br /> <br />II. ~~ k-~~~ <br />d2--~ M.L-' <br />
