Description of MTM Use. <br /> <br />a. MTM may operate trains from Soo Line junction to Locke Park and Twin Cities <br /> <br />Arsenal over MTRtracks; Operations on other trackage permitted by special permission. <br /> <br />b. MTM will use only AAR::-rules qualified people. <br /> <br />c. Non-revenue moves will have at least 2 member crew persons. <br /> <br />d. Revenue moves will have at least 4 member crew persons. <br /> <br />e. MTM op~rations may commence at 6:30 p.m. on Fridays and must terminate by <br /> <br />midnight on Sundays, unless otherwise approved by MTR in writing. MTM will agree to <br /> <br />modify its hours to accommodate MTR schedules, but MTR will not arbitrarily prohibit <br /> <br />or limit weekend excursion opera~ion by-MTM. <br /> <br />f. MTM will observe MTR traffic control procedures and obtain movement clearances. <br /> <br />g. MTR will maintain at least one live track .connection to MTM shops. <br /> <br />h. MTM will maintain all equipment operated on MTR track in safe mechanical conditic <br /> <br />i. MTM will leave MTR property in safe, operable condition after each use. <br /> <br />2. Term of Lease. <br /> <br />a. Agreement begins <br /> <br />, 1982, and continues for 30 years after that date. <br /> <br />b. Agreement renews automatlcally at end of term, unless either party seeks <br /> <br />renegotiation or termination. <br /> <br />c. Agreement is assignable to successor organizations, wl}o will be bound by terms. <br /> <br />d. MTM may terminate agreement on 90 days notice to MTR. <br /> <br />3. Payments. <br /> <br />a. MTM agrees to pay MTR 5% of gross annual railroad operating revenues for use. <br /> <br />b. MTR or successor may agree to waive this payment. <br />
