I've
discussed the matter with the City Attorney and he also feels the matter must
be handled accordingly.

Temporary Relocati~

As my memorandum of October 25, 1982 stated the temporary relocation would have
to be approved by the Council. The Council will have to waive the requirements
of Section 8-630 of the Zoning Code on the basis that the relocation is
temporary in nature. For Council consideration you should provide a location
and your plan for securing the bUilding. My memo also lists conditions the
Council will be considering. Also, keep the:Building Official, Ronald Nienaber,
informed so that you obtain all necessary permits.

Permanent Relocation

If it is your intent to relocate the building to a permanent site you will need
to make an application for building relocation. Said application requires the
submittal of the attached petition with signatures and an ownership report
certified by an abstract clerk listing the fee owners of the property within
200 feet of the site considered for relocation. In addition, there is a fifty
dollar filing fee.

The process for building relocation is as follows:

1. Staff sets public hearing - at least 10 days before hearing;
2. Planning Commission holds public hearing - third Tuesday of the
month; and
3. City Council takes action on request - 4th Tuesday of the month.

As your project progresses please keep me informed so that I am able to provide
any assistance you might need.

Q:e~~.
