EXTRACT FROM MINUTES NEW BRIGHTON PLANNING COMMISSION REGULAR MEETING AUGUST 17, 1982 SP-106~ RICHLAND, INC. SP-106 8:49 P.M. TO 9:25 P.M. Chairman l~il1iams opened the public hearing. Judy Linse, 2145 29th Avenue, stated that she opposed proposed application based on her experience with the site in regard to supervision. She stated that the supervisor was sometimes not even inside the facility and that supervisors that she has seen have been too young to properly manage the raci1ity. She noted that her sister was a manager of Arbys and had experienc~ with supervision of young people and stated that her sister felt that the supervisor,ls of the same age as the persons they are supervising that peer pressure is too great to have an orderly facility. She commented that on several occasions she has noticed broken glass outs i de the door, persons hangi ng around the door ~ bi kes 1 ayi ng down in front of the door and girls being chased home from the facility. She also said that she had secondhand information that a knife had been pulled outside of the amusement center and she wondered if the police ih.ad been ca-lled and whether or not there w,as a police record of this incident. She expressed concern about the numbers of young children in her neighborhood that were younger than four and one-half years old and that'if this particular hangout would spill into the new park it would cause vandalism prob1ems..,in the park and also safety problems for those young children.. She .stated that if th.e- operation ~a.s pro~r1y run as the Ci rcus Amuse:nent Cente,r 1 S, Whl ch had two supervisors in the building, one in the food area and one watching the machines and strictly controlled so that there were no kids hanging around and that there was alot of policing being done that this use would be acceptable. She stated ~hat . the teenagers that she'fd, seen in' this' facility-are at the age where t~ey needdlr~ctlon and proper supervision and neither are being provided by the owners of this facility. In addition she commented that she is not sure how management could assure the residents that the facility in the future would be propert1y supervised when it has been operating for a number of months and nothing has beeD done. She inquired if po 1 ice reports coul d be gathered to bring ,to the Ci ty Council's attenti on pertai ni ng t to incidents in the park and Rice Creek':Center area that could be re1a~ed to the amusemen center. She reiterated that she was strongly opposed to the approval of the request for the special use permit. ' Richard Ernst 'Senior was present representing the applicant. He stated that he was the owner of the Rice Creek Shopping Center and as the owner had the greatest interest in this particular use. He noted that his son owned and operated the facility and was unable to attend the public hearing. He stated that he felt that the amuse- ment center provided an area for children to meet and be kept busy playing games rather than hanging around interfering with other business operations. He stated that the age of the supervisors were young college students and that when the amusement center was first opened that an elderly couple was hired for supervision. He noted that originally when the amusement center was opened it was a retail sales of ice cream and a sales of game machines which could be used by the public and were sold to resorts and other businesses. He again noted that he had a stronger interest than anyone else because he owned the shopping center and did not want to create problems for other merchants.
