, SP-l06 Page #2 COMMENTS The applicant applied for and received a food establishment license to sell ice cream in September 9, 1981. Said license was renewed on April 1, 1982 and is valid until March 31, 1983. Staff inspected the site shortly after it opened and discovered 4 to 5 electronic games. Staff inquired of Mr. Ernst Sr. if it was his intent to have an amusement center because such use requires a special use permit. He stated it was not his intent. . On July 17, 1982 staff found that the Ice Cream Shop had 17 ~achines in it. Staff called Mr. Ernst Sr. and he stated that his son had already secured an application for a special use permit and ordered the required property owner list because of his expansion of the use of electronic games. Staff therefore notes that the amusement center use now exists without a permit authorized by the City Council. The primary objection to this proposed use at this particular site is the conflict between the sale of a1cholic beverages at the Pizza Factory across the hall and the resulting concentration of juveniles at this location. Staff feels that since the issuance of liquor licenses in the City is based on location to churches and schools places where there is a concentration of juveniles that an amusement center should not be allowed in such close proximity to an established business with the sales of alcoholic beverages. This proposed use would be as outlined in Section 8-130 injurious to the use and enjoyment of other property in the immediate vicinity for purposes already permitted. Staff feels that this concentration of juveniles in this location would adversely affect the operations of the Pizza Factory, result in more police monitoring in the area and be detrimental or endanger the public health, safety, morals, comfort of the general welfare. Minor concerns involve supervision. Twice that staff have been at the site it was difficult to determine who the supervisor was. Once the supervisor was out in hall of the center and not in the location. In addition, staff waited several minutes for the return of the employee in order to buy ice cream. Most communities require a supervisor that is 21 years old. There is no indication from the applicant the age of the proposed supervisor. Another concern related to the supervision is that if there is a supervisor located by the cash register by the ice cream counter persons in the billiard area are not visible. Another concern is over the keeping of , order and the parking of bicycles. The fire exit to the shopping center on the north has been obstructed by bicycles and a bike rake. Persons have been observed riding bicycles in the hall of the building and leaving thEm parked in the front of the amusement center inside the building. This situation if not controlled by management creates a fire hazard for the general public and other merchants who would be using this exit. Again this problem relates to management and supervision.
