<br />e <br /> <br />e <br /> <br />e <br /> <br />~TAFF COMMENTS <br /> <br />The applicant applied for an received a food establishment licens~ <br />to sell ice cream in September 9, 1981. Said license was renewed on <br />April 1, 1982 and is valid ~ntil March 31, 1983. Staff inspected <br />the site shortly after it opened and discovered 4to 5 electronic <br />games. Staff inquired of Mr. Ernst Sr. it it was his intent to have <br />an amusement center because such use requires a special use permit. <br />He stated it was not his intent. <br /> <br />On July 17, 1982 staff found that the Ice Cream Shop had 17 machines <br />in it. Staff called Mr. Ernst Sr. and he stated that his son had <br />already secured an application for a special use permit and ordered <br />the required property owner list because of his expansion of the use <br />of electronic games. <br /> <br />Staff therefore notes that the amusement center use now exists without <br />a permit authorized by the City Council. <br /> <br />The primary objection to this proposed use at this particular site is <br />the conflict between the sale of alcholic beverages at the Pizza <br />Factory across the hall and the resulting concentration of juveniles <br />at this location. Staff feels that since the issuance of liquor <br />licenses in the City is based on location to churches and schools, <br />places where there is a concentration of juveniles, that an amusement <br />center should not be allowed in such close proximity to an established <br />business with the sales of alcoholic beverages. This proposed use <br />would be as outlined in Section 8-130 injurious to the use and <br />enjoyment of other property in the immediate vicinity for purposes <br />already permitted. Staff feels that this concentration of juveniles <br />in this location would adversely affect the operations of the Pizza <br />Factory, result in more police monitoring in the area and be <br />detrimental or endanger the public health, safety, morea1s, comfort of <br />the general welfare. ' <br /> <br />Other concerns involve supervision. Twice that staff have been at the <br />site it was dif~i~uli to determine who the supervisor was. Once the <br />supervisor was out in the hall of the center and not in the location. <br />In addition, staff waited several minutes for the return of the <br />employee in order to buy ice cream. Most communities require a <br />supervisor that is 21 years old. There is no indication from the <br />applicant the age of the proposed supervisor. Another concern rea1ted <br />to the supervision is that if there is a supervisor located by the <br />cash register by the ice cream counter persons in the billiard area <br />are not visible. <br /> <br />Another concern is over the keeping of order and the parking of <br />bicycles. The fire exit to the shopping center on the north has been <br />obstructed by bicycles and a bike rake. Persons have been observed <br />riding bicycles in the hall of the building and leaving them parked <br />in the front of the amusement center inside the building. This <br />siutation if not controlled by management creates a fire hazard for <br />the general public and other merchants who would be using this exit. <br />One of these exit doors have been locked on two occasions which will <br />be addressed by staff. Again this problem relates to management and <br />supervision. <br />
