RESOLUTION NO NEW BRIGHTON PLANNING CO~MISSION RESOLUTION MAKING fINDINGS OF FACT AND RECOMMtNDING APPROVAL OF SPECIAL USE PERMIt, SP-108 WHE2EAS, an application for a special use permit, SP-108 has been made bv Eric Aaron to establish an amusement center at the Rice Creek Center; and WHEREAS, the orocedural history of the application is as follows:' oJ 1. That an application for a special use permit, SP-108 was filed with the City on September 28, 1982. 2. That the Planning Commission, pursuant to published and mailed notices, held a public hearing on October 19, 1982 and November 16, 1982, all persons present at the hearing were given an opportunity to be heard. NOW THEREFORE BE IT RESOLVED by the Planning Commission that the following Findings of F;act are made in respect to SP-108: 1. That the property is zoned B-3, General Business; 2. That the applicant will have no more than 25 machines at the site and have a supervisor of at least 21 years of age on duty at all times the business is open; 3. That with proper management1the establishment will not be injurious to the use and enjoyment of adjacent businesses; and 4. That the establishment, maintenance or operation of the special use will not be detrimental to or endanqer the public health, saf~ty, morals, comfort of the general \'Jelfare. BE IT FURTHER RESOLVED that the application SP-108 is and hereby recommended for approval subject to the following conditions: 1. That the applicant secure a Council approved amusement center license; 2. That there be nD more than 25 machines; 3. That the aDolic~nt work with the owner and other shopping c~~ter tenants to discourage/eleminate mall loiterinq after 8:00 p.m.; 4. That the bike r~_ be relocated at least 20 feet west of the north mall entrance; and 5.
