<br />RESOLUTION NO <br /> <br />NEW BRIGHTON PLANNING CO~MISSION <br />RESOLUTION MAKING fINDINGS OF FACT AND RECOMMtNDING APPROVAL <br />OF SPECIAL USE PERMIt, SP-108 <br /> <br />WHE2EAS, an application for a special use permit, SP-108 <br />has been made bv Eric Aaron to establish an amusement center <br />at the Rice Creek Center; and <br /> <br />WHEREAS, the orocedural history of the application is as <br />follows:' oJ <br /> <br />1. That an application for a special use permit, SP-108 <br />was filed with the City on September 28, 1982. <br />2. That the Planning Commission, pursuant to published <br />and mailed notices, held a public hearing on <br />October 19, 1982 and November 16, 1982, all persons <br />present at the hearing were given an opportunity to <br />be heard. <br /> <br />NOW THEREFORE BE IT RESOLVED by the Planning Commission <br />that the following Findings of F;act are made in respect to <br />SP-108: <br /> <br />1. That the property is zoned B-3, General Business; <br />2. That the applicant will have no more than 25 machines <br />at the site and have a supervisor of at least 21 years <br />of age on duty at all times the business is open; <br />3. That with proper management1the establishment will <br />not be injurious to the use and enjoyment of adjacent <br />businesses; and <br />4. That the establishment, maintenance or operation of the <br />special use will not be detrimental to or endanqer the <br />public health, saf~ty, morals, comfort of the general <br />\'Jelfare. <br /> <br />BE IT FURTHER RESOLVED that the application SP-108 is and <br />hereby recommended for approval subject to the following <br />conditions: <br /> <br />1. That the applicant secure a Council approved amusement <br />center license; <br />2. That there be nD more than 25 machines; <br />3. That the aDolic~nt work with the owner and other <br />shopping c~~ter tenants to discourage/eleminate mall <br />loiterinq after 8:00 p.m.; <br />4. That the bike r~_ be relocated at least 20 feet west <br />of the north mall entrance; and <br />5.
