<br />~ <br /> <br />J~! <br /> <br />STATEMENT OF REASON <br />FOR SPECIAL USE PEID1IT <br /> <br />JONES LAKE/RADIO TOWER <br /> <br />The project will consist of the construction of a <br />five hundred (500) foot radio tower in Jones Lake. The radio <br />tower will be supported on a drilled pier foundation. The <br />piers will have diameters ranging from 36 inches to 60 inches <br />and estimated lengths of 21 to 52 feet. Permanent steel <br />casing will be left in place at all pier locations to prevent <br />loss of concrete into the organic soils. Based on available <br />soil borings taken by Braun Engineering, it is their opinion <br />that the foundation will not totally penetrate the underlying <br />sandy clays and will not result in any drop in the lake <br />level. Construction during the winter freeze will also <br />minimize any impact on vegetation. <br /> <br />A special use permit is requested because there is <br />no alternative to construction of the radio tower in Jones <br />Lake.' Under Section 4-600c of the New Brighton Zoning Ordinances, <br />guyed structures, such as the radio tower, must have setbacks <br />equal to or greater than 75 percent of the height of the <br />proposed tower and a special use permit must be obtained <br />therefore. Additionally, a special use permit is requested <br />under Section 10-040b. (7). of the Zoning Ordinances for construc- <br />tion of the radio tower in Jones Lake. As noted above, because <br />of the setback requirements for th~ radio tower's height, the <br />tower's location in Jones Lake is necessary. Its construction <br />will not, however, adversely affect the capacity of the flowage <br />of Jones Lake. ~he Rice Creek Watershed District has approved <br />the construction of the tower subject to the Seminary giving <br />a flowage easement in Jones Lake. Further, a permit for the <br />tower's construction has been requested from and is being <br />processed by the Minnesota Department of Natural Resources <br />under Minnesota Statutes Sectlon 105.42. The U.S. Army Corps <br />of Engineers has advised that a permit under the River and <br />Harbor Act of 1899 is not required. <br /> <br />The construction of the radio tower will not be <br />detrimental to or endanger the public health, safety, or <br />general welfare, will not be injurious to the use and enjoyment <br />of other property in the immediate vicinity for the purposes <br />already permitted, will not impede the normal and orderly <br />development and improvement of the surrounding property, <br />will have adequate access roads, drainage, and other necessary <br />facilities and will in all other respects conform to the <br />applicable regulations for special uses in floodplain districts <br />under Section lO-llOd. of the New Brighton Ordinances. <br />
