DATE: September 1, 1970 <br />CASE NUMBER: VN-69 <br />APPLICANT: Bell Lumber and Pole Company <br />LOCATION: 778 First Street Northwest <br />REQUEST: Variance to construct structure of excessive height in an <br />Industrial Zone. <br />PLANNING CONSIDERATIONS: <br />The request has been submitted to provide storage and handling facilities for wood <br />chips in order to curtail the current burning of such materials in compliance with <br />State and Village air pollution control measures. <br />Village of New Brighton Ordinance No. 188, Section 10, Subsection 10-090, <br />paragraph (f) indicates that "No building constructed in any industrial district shall <br />be more than fovrty (40) feet in height. The request is to construct afifty-two (52) <br />foot structure to handle and store wood shavings. <br />• Section 10, Subsection 10-100 Exceptions indicates that "Height limitations as set <br />forth in this Ordinance shall not apply to church spires ... grain elevators and <br />similar construction unless in the opinion of the building inspector such construction <br />might be dangerous or in other ways detrimental to surrounding property in which <br />case a special permit by the Council shall be required". <br />Conversation with the Building Inspector indicated that he felt that no particular <br />dangers were inherent within this structure, however, he felt the proposal should be <br />reviewed by the Commission and Council. <br />The description of the proposed structure appears to qualify for the "Exceptions" <br />clause in the Ordinance. <br /> <br />
