Ramc~.~ ('n.~.~+t•+ M nr.ocnt~
FROM:, John W. Hillyard & Darlene D. Hillyard, 1830 Long Lake Road, New Brighton
SUB.TECT: Request to Divide with platting the following property:
.'art of'North (6) acres of SW 1/4, of SE 1/4, of SE 1/4,
Sec I8, Township 30, Range 23, lying South of North
' 330..74 ft. thereof.
i
ATTACHMENTS:,' 1. Request for VARIANCE with Abstracters certificate showing
all property within 200 ft. of above property.
2. Scetch Map.
This request for dividing without platting the above described property is
submitted concurrently with the attached "Request f.or Variance", for the purpose
of making that part of the. above property facing 20th Avenue NW saleable to a
second party for the purpose of building a residence.
The intention is to divide the total property, less the road easements for
Long Lake Road and 20th Avenue NW, into two equal halves ie,}divided by a .line
roughly parallel t.o Long Lake Road and 20th Avenue NW. More specifically, the
total property would be divided by a line connecting the points bisecting the
North and South boundries after the road easements have been deducted. (Total
length 658+ ft. less Road Easements of 33 ft. and 30 ft, leaves 595 ft, divided
by two (2) = 298 ft. of length times 67 ft, width = APPROX. 19,900+ sq, ft. of
AREA).
The variance is requested for the western half of the property so divided,
based on the following elements:
A. UNDUE HARDSHIPS:
1. .Since no contiguous land is owned, without the variance,
there is no other alternative which would not limit individual
freedom of choice as to when or how the property can be sold.
The land by itself has no other practical value.
2. Street, storm sewer, curb, etc. are in, resulting in
major assesments and a financial burden - one of the major.
reasons for a desire to sell the property.
B. UNIQUE CIRCUMSTANCES:
1. Although the property was not platted prior to the passing.
of ordinance 188, it was purchased substantially prior to its.
passage (1949)
2. The width (66.89 ft.) exceeds the minimum (75% of 75 ft.
yr X0.25 ft./ aCCC~.able fCJr Those. properties piatt.ed at the
time of passage of ordinance 188 by 10.64 ft; and the total
area of approximately 19,900 sq. ft. exceeds the standard
minimum lot size of 10,000 sq. ft. by almost double.
C. The above do apply to the property divided as above.
~7~i ~~~~
J. W. HILLYARD
~~
~::
