McGraw -Manager Rubbish Removal, Irac. <br />LOCATION: 1st Street Northwest and Old .Highway 8 <br />REQUEST: Variance to construct office building addition to existing structure <br />PLANNING CONSIDERATIONS: <br />The property in question is the present operational site of Rubbish Removal, Inc. <br />Structures on the site presently are of an industrial nature and as indicated by the <br />petitioner are not totally in conformance with all aspects of the zoning ordinance. <br />The request is to extend the existing structure known as 1021 1st Street Northwest <br />northward a distance of 20 feet for use as ;office faci I i ties. <br />Under the provisions of Village of New Brighton Ordinance .188, Section 10-090 <br />Industrial Districts (-1 and I-2 a minimum setback of 100 feet is required for in- <br />dustrial structures where an I-1 or 1-2'-zone are separated from any class of resi- <br />dential district by a street. In addition, under the same section, paragraph (h) <br />"In any Industrial district the front yard and~or any side yard bordering upon a <br />street shall be landscaped and shall not be used for parking" <br />It would appear that the use for which the variance is requested while an adjunct <br />facility'-to an industrial use is more'necrly similar to a business use than:an Indus- <br />trial use...Restrictions with 'regard to setback and parking in a business use area <br />are substaritially less stringent than those specified for an Industrial District while <br />the drawings presented with the request do not specify tree sizes or dimensions <br />and .locations of buildings with respect to the land parcel. The drawing of the <br />proposed layout of the plant appears to be a substantial improvement to the prop- <br />erty. <br />If a variance is to be granted in this instance it should contain specific compli- <br />ance provisions to assure the Village ;that whatever is done to i~he property will in <br />fact improve it from its present condition. It appears that sufficient conditions <br />for the granting of a variance under the terms of the ordinance do exist. <br />
