DATE: December 15, 1970 <br />CASE NUMBER: VN-70 <br />APPLICANT: J.W. and D. D. Hillyard <br />LOCATION: 1830 Long Lake Road. <br />REQUEST: Variance in minimum lot width and permission to subdivide property <br />without platting <br />PLANNING CONSIDERATIONS: <br />The property in question is described as a gently rolling long narrow tract lying 330.74 <br />feet south of 19th Street North extending from Long Lake Road to 20th Avenue North- <br />west. The size of the parcel for which division without platting and variance in lot <br />width have been requested is approximately nine tenths of an acre. It is evident that <br />division. of property to the south of the parcel in question will be divided on a north- <br />south orientation, facing the new road extending from Long Lake Road to 20th Ave- <br />nue Northwest. <br />The description of the property given by the petitioner and the parcel as delinected on <br />the section map do not match (one of the difficulties in Metes and Bounds descriptions <br />for property decision). However, the property in terms of area could under present <br />10,000 square foot minimums accommodate three single family dwelling units. The <br />petitioners-are requesting division of the parcel into two Lots and variance on the <br />minimum lot width for an indefinite time. Under Ordinance 188, Section 11-070 <br />"a special use permit or a variance permit, when not used, shall expire after 180 <br />days after date of issuance unless written application for renewal or time extension is <br />received and granted by the Village council prior to the expiration date. <br />Under the conditions of the surrounding property and its probable eventual division it <br />is difficult to see how this property can be divided in any way other than that indi- <br />cated by the petitioner unless some. amalgamation of properties were to occur. <br />Platting the division of the property which would also require a variance in the platting <br />procedure would relieve the need for an indefinite extension of the requested variance <br />and would also facilitate description and title transfer on the property in question. <br />In any event prior to any action on the parcel, a dedication of rights-of-way for 20th <br />Avenue Northwest and Long Lake Road should replace the present easements on the <br />property. <br />
