DATE: December 15, 1970
CASE NUMBER: VN-71 Rubbish Removal, Inc.
APPLICANT: Dennis R. McGraw -Manager Rubbish Removal, Inc.
LOCATION: 1st Street Northwest and Old Highway 8
REQUEST: Variance to construct office building addition to existing structure
PLANNING CONSIDERATIONS:
The property in question is the present operational site of Rubbish Removal, Inc.
Structures on the site presently are of an industrial nature and as indicated by the
petitioner are not totally in conformance with all aspects of the zoning ordinance.
The request is to extend the existing structure known as 1021 1st Street Northwest
northward a distance of 20 feet for use as office facilities.
Under the provisions of Village of New Brighton Ordinance 18$, Section 10-090
Industrial Districts I-1 and I-2 a minimum setback of 100 feet is required for in-
dustrial structures where an I-1 or I-2-zone are separated from any class of resi-
dential district by a street. In addition, under the same section, paragraph (h)
"In any Industrial district the front yard and/or any side yard bordering upon a
street shall be landscaped and shall not be used for parking"
It would appear that the use for which the variance is requested while an adjunct
facility-town industrial use is more nearly'similar to a business use than an Indus-
trial use., Restrictions with regard to setback and parking in a business use area
are substantially less stringent than those specified for an Industrial District while
the drawings presented with the request do not specify tree sizes or dimensions
and Jocations of buildings with respect to the land parcel. The drawing of the
proposed layout of the plant appears to be a substantial improvement to the prop-
erty.
If a variance is to be granted in this instance it should contain specific compli-
ance provisions to assure the Village that whatever is done to fhe property will in
fact improve it from its present condition. It appears that sufficient conditions
for the granting of a variance under the terms of the ordinance do exist.
