Gillman <br />LOCATION: 1403 Silver Lake Road <br />REQUEST: Variance allowing the parking lot to extend 7 feet over the setback line <br />along 14th. <br />PLANNING CONSIDERATIONS: <br />The property in question was the subject of Variance Request ~/N-79 reviewed by the <br />consultant and Planning Commission on September 21, 1971. Action taken by the <br />Planning Commission at that time was to recommend denial of the Variance Request <br />and initiation of action to bring the development into conformance with the setback <br />requirements for the district. <br />The developer was evidently in violation of the Ordinance prior to the issuance of <br />the building permit for the structure and was directed to file petition for the variance <br />in order to receive the required building permit. <br />Our professional opinion remains unchanged in light of the preceeding paragraph <br />and our recommendation remains that the request for variance be recommended for <br />denial by the Council. It does not appear that all conditions required for the <br />granting of a variance are present, in this particular case, in our judgement. <br />
