DATE: October 17, 1972 <br />CASE NUMBER: VN-80 <br />APPLICANT: A. C. Anderson <br />LOCATION: West of Old Highway 8 North of Rush Lake <br />REQUEST: Variance to allow front yard parking in setback <br />area <br />PLANNING CONSIDERATIONS: <br />The Variance under consideration was originally reviewed <br />by the Planning Commission at the regular meeting on <br />November 19, 1971. Following a Public Hearing called for <br />December 14, 1971, approval of the Variance was granted <br />subject to the conditions that: (1) the developer in- <br />corporate the right-of-way area into the landscape plan, <br />and (2) that in the event the right-of-way or any portion <br />thereof reverted to the owner it would remain a green <br />area. <br />Subsequent planning on the part of the petitioner indicates <br />that he intends to comply with the conditions upon which <br />the approval was originally granted. While some changes <br />in the petitioners development plan have occurred, it <br />appears that the conditions for which the Variance was <br />originally requested and granted are still substantially <br />the same. <br />Under the provisions of the New Brighton Zoning Code, <br />Section 11-070 Time Limit, ."A variance when not <br />used, shall expire after 180 days after date of issuance <br />unless written application for renewal or time extension <br />is received and granted by the Village Council prior to <br />the expiration date." <br />
