DATE: October 17, 1972
CASE NUMBER: VN-80
APPLICANT: A. C. Anderson
LOCATION: West of Old Highway 8 North of Rush Lake
REQUEST: Variance to allow front yard parking in setback
area
PLANNING CONSIDERATIONS:
The Variance under consideration was originally reviewed
by the Planning Commission at the regular meeting on
November 19, 1971. Following a Public Hearing called for
December 14, 1971, approval of the Variance was granted
subject to the conditions that: (1) the developer in-
corporate the right-of-way area into the landscape plan,
and (2) that in the event the right-of-way or any portion
thereof reverted to the owner it would remain a green
area.
Subsequent planning on the part of the petitioner indicates
that he intends to comply with the conditions upon which
the approval was originally granted. While some changes
in the petitioners development plan have occurred, it
appears that the conditions for which the Variance was
originally requested and granted are still substantially
the same.
Under the provisions of the New Brighton Zoning Code,
Section 11-070 Time Limit, ."A variance when not
used, shall expire after 180 days after date of issuance
unless written application for renewal or time extension
is received and granted by the Village Council prior to
the expiration date."
