<br />I <br /> <br />I <br /> <br />I <br /> <br />Council Meeting Minutes <br />January 12, 1988 <br /> <br />3enke stated, in these circumstances, he is not sure what the <br />ponding requirements would be as it is complicated with geology <br />and contamination concerns; and believes we should wait and deal <br />with them once we receive the findings of the RCWD and MPCA. <br /> <br />Williams supports Benke's suggestions; since two other agencies <br />have a fair amount to say about the those particulars, it would be <br />prudent for us to wait. <br /> <br />Brandt asked how long it will take to get the agenciesl recommen- <br />dations; Mattila estimated it could be two months before the RCWD <br />rendered action on this case. <br /> <br />Benke suggested a moratorium may be desirable; other properties <br />could conclude storage requirements within that same time-frame; <br />moratorium would not have much affect. <br /> <br />LeFevere stated if the review process took that long and the mora- <br />torium were put into affect for a period of time, if that length <br />were shorter the moratorium would not affect the application. <br /> <br />Benke asked if the proposed six-month moratorium could be short- <br />ened; LeFevere stated it could be shortened or extended. <br /> <br />Kevin Ellis, attorney for Boerner Building Systems, stated Boemer <br />has been wrestling with the problems created with stormwater re- <br />tention; feel they have supplied information that it is not neces- <br />sary; for a dust-free site, they are willlng to spend $98,000 to <br />comply with that condition; applicant is willing to comply with <br />all ten conditions; is here tonight requesting the city to adopt a <br />resolution approving the matter subject to contingencies. If <br />Boerner cannot meet the RCWD or MPCA requirements, Ellis stated <br />they will not receive a permit; and indicated Boerner would like <br />tne matter to be resolved this evening. <br /> <br />Ellis continued that Boerner had submitted plans to the MPCA and <br />has a letter dated August 20, 1987 in which the MPCA approved the <br />site plan based on the use of a gravel base; the MPCA's only in- <br />structions were to preserve the thickness and integrity of the <br />soil which has been covered over the landfill which exists on the <br />site. <br /> <br />Regarding the RCWD, Ellis stated they were uncertain what storm- <br />water ponding would be required as that would be based on city <br />engineer's recommendation; however, there are nine acres of site <br />to work with for ponding, if necessary, and stormwater retention <br />so he does not believe there will be a problem. <br /> <br />Ellis further stated site was purchased by the applicant in 1987 <br />to build a truck storage facility and noted a truck yard is a per- <br />mitted use in the zoning ordinance. The proposed use includes <br />1,000 square feet to perform general contract services on the <br />site. Ellis indicated the site is unique because it is immediate- <br /> <br />Page 9 <br />
