:a <br />COUNCIL PROCEEDINGS <br />VILLAGE OF NEW BRIGHTON <br />Pursuant to due call and published notice thereof, a special meeting <br />was held at 7:30 p.m. August 2, 1973 in the Municipal Building, 803 <br />5th Avenue N.W., New Brighton, Minnesota <br />Present: Mayor Gayle C. Bromander, Councilmen Donald Anderson, <br />Diana Eagon, Gene Fisher. <br />Absent:- Councilman Rebelein <br />Also Present- Thomas F. Lewcock, Village'Manager; Perry Copeland, <br />Village Attorney; Quentin'K. Wood, Director of Public <br />Works; Vernon C. Pederson, Village Clerk <br />Unfinished Business <br />Motion by Eagon, seconded by Anderson to receive letter <br />from Mr. Larry Swick, president of Brighton Square Homes <br />Association VN-107 <br />4 ayes - 0 nayes - carried Nelson's <br />Restaurant <br />Motion by Fisher, seconded by Anderson -to grant variance <br />VN-107, Nelson's Restaurant for purposes of less than the <br />required 100 ft. setback of loading zone from residential <br />property and for a 15 ft. front yard parking setback and <br />a 9'ft. parking' setback in the area designated for handicap <br />access and in accordance to the plans signed by Daniel <br />Englesma dated August 2, 1973 subject to the following <br />conditions. <br />1. The developer provide the Village with proof of an <br />agreement between the Brighton Square Homes Association <br />and Kraus-Anderson insuring that the landscape will be <br />done in accordance with the above noted plan and the below <br />conditions and that Brighton Square Homes Association will <br />permit Kraus-Anderson access to their property for purposes <br />of complying with the landscape plan, such agreement subject <br />to the review and approval of the Village Attorney prior to <br />issuance of the building permit. <br />2. That off-street loading for the restaurant be restricted <br />to the hours of 8 a.m. to 5 p.m. <br />3. That should the council at a later date determine that <br />the odor control system is inadequate, Krause-Anderson and/or <br />Nelson's Restaurant will , by council direction, install a <br />more adequate. odor control system.
