<br />I <br /> <br />I <br /> <br />I <br /> <br />Council Meeting Minutes <br />December 22, 1987 <br /> <br />Benke indicated staff1s condition speaks to bituminous surface and <br />asked if staff is referring to a fresh bituminous mix; Mattila re- <br />sponded affirmatively, versus the chunks of bituminous and con- <br />crete in a clay-fine base, which poses a potential for the genera- <br />tion of dust. <br /> <br />Instead of requiring a bituminous surface which would cost the ap- <br />plicant an additional $100,000, Brandt asked if it would be pos- <br />sible to require a dust-free surface with some conditions for on- <br />going maintenance (for example, requiring the applicant to seal <br />coat at intervals when the city determines it is necessary). <br /> <br />If this particular applicant were to move off the site, Mattila is <br />concerned it would be an enforcement problem for the city. <br /> <br />LeFevere agrees there could be enforcement problems with site plan <br />approval conditions, and does not believe a court could order a <br />remedy to a dust problem by another tenant. <br /> <br />Williams stated he is not very enthusiastic about the proposal; <br />the city has invested in the Old Highway 8 Corridor Plan and we <br />have said on a number of occasions that Highway 8 is one of the <br />entrances to the city and we are going to try to do all that is <br />possible to make that entrance attractive; and is concerned there <br />will be more trucks on the road in an area we are trying to devel- <br />op into high-quality office space and have been successful in ac- <br />complishing some of that over the last several years. <br /> <br />Blomquist recalled there have been problems in almost every situa- <br />tion where we have not interpolated as being bituminous. <br /> <br />Motion by Gunderman, seconded by Williams, to REFER MATTER TO <br />STAFF FOR THE PREPARATION OF FINDINGS OF FACT JUSTIFYING A DENIAL. <br /> <br />3 Ayes - 2 Nayes (Brandt, Blomquist), Motion Carried <br /> <br />Locke reviewed staff report concerning a 91 unit, elderly orien- <br />ted, apartment building to be located in the southwest corner of <br />Tenth Street and Third Avenue N.W. <br /> <br />Gene Rezac, Graystar Enterprises, Inc., the developer, reviewed <br />plans for the contractor, architect, and financing; and indicated <br />the development will be presented to the Planning Commission in <br />January. <br /> <br />In response to Benke's question, Rezac indicated he had spoken <br />with three of the four homeowners that will be involved in t,e ac- <br />quisition process; and will be setting up a meeting with the home- <br />owners and a relocation expert within the next two weeks. <br /> <br />Benke asked if a two-year old market study had been updated; Rezac <br />responded that an updated study will be completed by the end of <br />January and it will then be made available to councilmembers. <br /> <br />Locke reported that, following a recommendation from the Planning <br />Commission1s January 19, 1988, meeting, this item would be on the <br />January 26, 1988, council agenda with plans. <br /> <br />Page 10 <br /> <br />Development <br />Agreement <br />Golden Pond <br />Report 87-329 <br />Resolution 87-147 <br />
