H2 <br />Dear Mr. Ernst: <br />At its February 12 meeting, the City Council again deferred <br />action on your requested variance VN-111. <br />The Council has directed the administration to inform you that <br />the report which was ordered is to be received by them at their <br />next meeting or, failing that, you should be prepared to docu- <br />ment that you have hired a consultant, when he was hired, and <br />when his report will be completed. You should also be prepared <br />to explain the delays or problems that the consultant has <br />encountered which have delayed his report. <br />Lacking such a report or good reason why the report has been <br />delayed, the Council is prepared to order you to hire, at your <br />cost, a consultant of the Council's own choosing. To ensure <br />compliance with that requirement and ensure that the consultant <br />would be paid, the Council is prepared to consider revocation <br />of the present Certificates of Occupancy for the 7-Eleven Store <br />and the 1-Hour Martinizing, and to prohibit the issuance of <br />Certificates of Cccupancy to new tenants. I am enclosing a <br />copy of the Council minutes detailing their action on this <br />matter. <br />I would also like to note to you that the requested report <br />should be received by me no later than Monday, February 20. <br />Very truly yours, <br />Barry P.
