To remedy this., the applicant proposes to expand the <br />blacktop area farther to the east toward Old Hwy. 8. <br />-This proposed expansion would'be into -the front yard:and therefore <br />requires a variance. Either late th-is year, or next year, the .applicant <br />.intends to expand-the .present. building to the east in sucha way that <br />the. proposedparking expansion would be wholly in the side yard. <br />The, applicant-also owns. property on the east side of Old Hwy: 8 which <br />is also intended .for employee parking at a future date. <br />I't should also be noted that-the existing parking.. area-extends into the <br />.front yard in violation of Code requirements. Tn7hile none of our plans <br />show :the parking. area laid out as •it was, . in fact, constructed, our <br />,plans do show designated parking-areas extending. into the front yard, <br />"No variance was granted. <br />It appears that the property is presently in anon=conforming status <br />and that the applicant's request is one pf expanding anon-conforming..: <br />:use,: <br />The staff ishaving considerable difficulty establishing the meaning <br />-and intent-of much of the chapter on non-conforming use$ and so it can- <br />not even comment on whether. the Code permits granting the. applicant's <br />request. ,A ong letter has been directed to the City Attorney asking <br />his opinion relative to many of these, questions ., We have, not yet= <br />received his answer. <br />
