The elevation of the pad is about 5 feet <br />above the `center.. line of":3rd `Street SW. The pad is located <br />~n what is actually the front yard. of the lot. <br />Because of the relative differences in elevation between <br />the:pad and the roadway, any fence, no matter what its <br />height, would interfere with the line of .sight of drivers <br />approaching the intersection. The Zoning Code does not <br />permit his (Section 13-060). <br />' The. existence of a stop sign on 3rd Street SW somewhat <br />- reduces the concern regarding the effect on line of <br />sight which .the fence v+o uld have. It should be noted- <br />that contours of the yard already block a driver's line, <br />of sight. Our records do not show that a permit was ever <br />taken out for this grading and for the laying of the slab, <br />although this may have been included in the permit for the <br />house. At any rate, existing-grades on the preliminary plat <br />showed this area about 22' above the street elevation vahich <br />would not have"created a problem. <br />This fence is-going to severely screen the lot to the east. <br />`The pad runs from one side lot line to the other and on <br />the- east is about 2~' -3' above the grade of the "abutting <br />lot. The result of .putting in the fence would be a <br />barrier with no setback 12~'-~.3' above the grade of the <br />abutting lot.. This. fence will extend within 24' of the <br />-.road whereas the house-on the next lot will be no closer <br />than 46' to the road... The house will be completely hidden <br />~. <br />f <br />
