41 Public Hearing <br />VN-12 2 <br />June 11, 1974, 8:25 P.M. <br />APPLICANT: Lawrence Steltzner <br />LOCATION: 315 5th Ave. N.W. <br />REQUEST `g _-Variance from Sections 12-045 (e):and 12-060 (a) <br />.---r- to develop site without curbing around parking <br />area And driveway. <br />DISCUSSIONS <br />The applicant)is intending to construct a second building <br />on the same, site with,the building occupied by Designed Fiber- <br />glass. The second building will be used to store much of the <br />material which is presently located outside the existing <br />building. This will abate a condition which is a violation <br />of the nuisance ordinance and which the applicant has been <br />told to correct. <br />The present building meets neither front nor rear yard set- <br />back,requirements. A variance for the latter was granted, On <br />the basis of the former condition, the building is a legally, <br />established non-conforming structure. <br />The proposed building will meet all setback requirements and <br />on this basis the City Attorney has stated in a samilar case <br />that it would not constitute expansion of a non-conforming use <br />and would be permissible. <br />The applicant's property is nearly level and only 8" above <br />the level of the adjacent roadway. There is a slight slope <br />toward the road and toward the street easement to the south. <br />It is the applicant's contention that the slight slope com- <br />bined with concrete curbs would result in his parking area <br />being flooded. The City Engineer believes that the curbs <br />would not cause a problem if there were more slope in the <br />parking areas <br />The applicant is requesting a variance from Sections 12-045(e) <br />and 12-060(a) which require concrete curbs around parking_ <br />and driveway areas. We have understood the Council's <br />intent in these sections to be to require poured concrete curbs <br />rather than concrete bumper-type pre-formed curbs. As the <br />narking lot itself will be entirely surrounded by buildings <br />and fencing curbs will serve no function in ItEeping,'vehicles. <br />out of the setback area.
